The Ministry of Justice and the Ministry of Finance have given their opinions on investing in the railway connecting the center of Ho Chi Minh City to Can Gio.

The two ministries have given their opinions on the proposal to add the railway to Can Gio to Resolution 188 to apply special mechanisms when implementing investment.

The Ministry of Justice and the Ministry of Finance have just sent official dispatches to the Government Office and the Ministry of Construction to comment on the proposal of the Ho Chi Minh City People's Committee to add the railway line connecting the center of Ho Chi Minh City to Can Gio district to the list of projects that are subject to the special mechanism of Resolution 188 on urban railway development in Hanoi and Ho Chi Minh City.

From a legal perspective, according to the Ministry of Justice , Resolution No. 188 provides that the Government may decide to adjust the list of planned projects in the appendix based on local proposals. Therefore, the proposal to the Government to approve the addition of the above urban railway line to the list of projects attached to Resolution No. 188 is within its authority.

Currently, the Prime Minister also assigned Ho Chi Minh City to urgently organize research and implementation, and at the same time call on investors and contractors with capacity to participate in investment, and report in April 2025. However, Resolution 188 currently does not have a specific legal mechanism on the above content, but only regulates the mobilization and arrangement of capital from public investment and mobilization of official development assistance (ODA) capital, foreign preferential loans to implement projects.

Therefore, according to the Ministry of Justice, in case this project is added to the list attached to Resolution 188 with the mechanism for implementing the project using private investment capital, Ho Chi Minh City needs to clarify which mechanism to follow to ensure feasibility and legality in implementation.

According to the Ministry of Justice, the Ministry of Construction has submitted a draft resolution to the National Assembly to pilot a number of specific and special mechanisms and policies for investment in developing the railway system, including the Can Gio railway project in the appendix. Therefore, the Ministry of Construction requested Ho Chi Minh City to coordinate with the Ministry of Construction to handle it, ensuring it is reasonable, feasible, and in accordance with legal regulations.

Meanwhile, the Ministry of Finance said that the Ho Chi Minh City Planning for the period 2021-2030, with a vision to 2050, has established a plan to study and develop a potential urban railway line connecting with the Can Gio coastal tourist urban area. The Prime Minister also directed Ho Chi Minh City to urgently organize research and implementation of the project.

According to the Ministry of Finance, adding the urban railway route to Can Gio to the list of projects attached to Resolution 188 will allow the application of specific policy mechanisms to mobilize all legal resources to implement investment, shortening the procedures, investment preparation time, and implementation progress to the maximum...

At the same time, decentralize and delegate authority to the City in implementing investment to ensure it is appropriate to the actual situation, characteristics and development requirements; promote the initiative and positivity of the locality. Thereby contributing to ensuring the effectiveness and progress of project investment according to the Prime Minister's direction.

The Ministry of Finance requested the Ministry of Construction, as the specialized ministry directly managing transport, to coordinate with Ho Chi Minh City to assess the necessity and effectiveness of project investment to report to the Government and the Prime Minister to include it in the project list attached to Resolution 188.

At the same time, clarify the capital source and the ability to balance capital to implement the project to ensure investment efficiency and avoid loss, waste, corruption and negativity in project investment. The Ministry of Finance requested the Ministry of Construction to study, synthesize and report to the Prime Minister for consideration and decision.
