Continuing the program of the 9th Session, on the morning of May 19, Minister of Finance Nguyen Van Thang presented to the National Assembly a report on the transition to applying a number of special mechanisms in a number of localities after restructuring the apparatus and expanding administrative boundaries according to the policies of the Party and State.
According to the Government 's proposal, Resolution 60/2025 of the 13th Party Central Committee decided that local governments are organized at two levels, including: provincial and centrally-run cities and commune levels (communes, wards, special zones under provinces and cities). The district level will cease to operate. After the merger, the number of administrative units will be reduced from 63 to 34 provinces and centrally-run cities.
The Government believes that the arrangement of provincial-level administrative units aims to maximize the potential and advantages of socio -economic development of each locality, supporting each other to promote socio-economic development.
The Government said that up to now, there are 10 localities nationwide, including Hanoi, Hai Phong, Thanh Hoa, Nghe An, Hue, Da Nang, Khanh Hoa, Buon Ma Thuot, Ho Chi Minh City and Can Tho, that are applying special mechanisms and policies according to separate laws and resolutions of the National Assembly.
Of these, 6 localities will be directly affected by the reorganization of local government at 2 levels, including: Hai Phong, Da Nang, Khanh Hoa, Dak Lak (related to Buon Ma Thuot City), Ho Chi Minh City and Can Tho.
This impact is due to the merger of provincial administrative units and the end of district-level activities, leading to changes in geographical boundaries, management scope, population size, legal status, etc. of localities.
Therefore, the Government proposes to have transitional regulations on the continued application of specific mechanisms and policies currently being implemented in localities subject to rearrangement. This is to ensure continuity and stability of legal regulations in management, operation and socio-economic development in these localities.
According to the Government, maintaining specific mechanisms and policies for localities that are currently being applied, after merging and rearranging 2-level administrative units, will create conditions to create new growth momentum and resilience for localities.
At the same time, avoid creating legal gaps for localities after the arrangement in handling issues related to investment projects, financial obligations, etc.
The Government proposed that the National Assembly allow the merged localities, including Hai Phong, Da Nang, Khanh Hoa, Ho Chi Minh City and Can Tho, to continue implementing the previous special mechanisms and policies.
In particular, the new communes and wards in Buon Ma Thuot City (Dak Lak Province) after the commune-level arrangement will continue to apply the specific mechanisms and policies that the National Assembly has allowed to implement.
After the arrangement of two-level administrative units is completed, the Government will summarize and evaluate these specific mechanisms to adjust and supplement them to suit the reality and new situation, or legalize them for nationwide application.
Examining this content, the National Assembly's Economic and Financial Committee believes that allowing the transition to apply a number of mechanisms and specific features at the local level after the administrative unit arrangement is not simply to expand the scope of application of the mechanism, but also involves many aspects of economics and budget (implementation resources, budget revenue and expenditure policies).
Therefore, the Committee recommends that the Government assess the impact of policies to ensure the principle of balancing revenue and expenditure in accordance with the State Budget Law.
In addition, there are opinions in the appraisal agency suggesting that for cities applying special mechanisms and policies to merge into provinces, it is necessary to redefine the regulation ratio to account for and divide the central and local budgets.
