Timely institutionalization of policies and guidelines of Resolution 68
On May 14, the Government submitted a Draft Resolution of the National Assembly on a number of special mechanisms and policies for private economic development. The document stated that Resolution 68 of the Politburo on private economic development is the most important driving force of the national economy, especially private economic development, to the National Assembly for promulgation at the 9th Session of the 15th National Assembly.
The objective of this Resolution is to promptly institutionalize the Politburo's policies and guidelines stated in Resolution 68 to improve the investment and business environment; create favorable conditions for the private economy to access resources; promote science and technology, innovation and digital transformation, green transformation, human resource training, expand the participation of private enterprises in important national projects, support pioneering enterprises, and reach international standards to create "pushes, levers, and fulcrums" to create new momentum, liberate resources, and productivity of the private economy.
The Resolution on special mechanisms is built on five viewpoints. Firstly, ensuring the full and timely institutionalization of the outstanding policies, viewpoints, mechanisms and policies in Resolution 68, removing bottlenecks in private economic development.
Second, regulations on a number of specific mechanisms and policies for private economic development under the decision-making authority of the National Assembly are different from the provisions of current law or have not been specifically regulated.
Third, closely follow the spirit of Conclusion No. 119 of the Politburo, clearly defining authority in law-making according to regulations.
Fourth, prescribe specific mechanisms and policies, especially for private economic development, to mobilize and diversify resources and free up social resources to focus on rapidly developing socio-economic infrastructure, meeting the requirements of double-digit economic growth in the next period.
Fifth, ensure the constitutionality, legality, and consistency of the legal system; compatibility with international treaties to which Vietnam is a member; feasibility and suitability with State resources.

3 groups of solutions
Based on Resolution 68, and at the same time reviewing the system of related legal documents and laws that are expected to be amended and supplemented to be submitted to the National Assembly for approval at this Session, the tasks and solutions are classified and proposed to institutionalize Resolution 68 into 3 groups.
Firstly, the Draft Resolution focuses on groups of tasks and solutions with relatively clear content, urgent nature, needing immediate resolution, having a major impact on the confidence, production and business activities of the private economic sector but not yet institutionalized or needing amendments and supplements, under the authority of the National Assembly; at the same time, not within the scope of regulation of the Laws in this Session's Law-making Program.
Institutionalization according to 5 major policy groups including: Improving the business environment; Supporting access to land resources, production and business premises; Supporting finance, credit and public procurement; Supporting science, technology, innovation, digital transformation and human resource training; and Supporting the formation of medium and large enterprises and pioneering enterprises.
Second, for the tasks and solutions stipulated in Resolution 68 that need to be institutionalized, amended, and supplemented immediately and are within the scope of regulation of a number of Laws in the Law-making Program at the 9th Session, the Government assigns the agencies in charge of drafting these Law projects to urgently review, research, and institutionalize them in the draft Laws, ensuring the consistency and synchronization of the legal system.
Thirdly, for tasks and solutions stipulated in Resolution 68 that are orientational in nature and not urgent, requiring time for careful research and evaluation, the Government assigns research agencies to develop or amend and supplement relevant laws and submit them to the National Assembly for consideration and approval at the next sessions.
At the same time, some principles are stipulated in the draft Resolution as a guideline for amending upcoming legal documents.

Layout of the draft Resolution
The Government's submission stated that the Draft Resolution consists of 7 chapters and 17 articles, stipulating a number of specific mechanisms and policies, especially for private economic development; applicable to enterprises, business households, business individuals and other relevant organizations and individuals.
The basic content of the draft Resolution is as follows:
Chapter I: General provisions
Contents on scope of regulation, subjects of application and explanation of terms to ensure unified understanding of some terms used in the draft Resolution.
Chapter II: Improving the business environment
Regulations on principles of inspection, examination, licensing, certification, access to resources, ensuring equal competition for enterprises, business households, and individual businesses.
Regulations on principles for handling violations and resolving incidents in business activities.
Resolving corporate bankruptcy under simplified procedures.
Chapter III: Support for access to land and production and business premises
Regulations on special support policies of the State, specifically including: Support for access to land, production and business premises in industrial parks, industrial clusters, technology incubators; Support for renting houses and land that are public assets.
Chapter IV: Financial support, credit and public procurement
Regulations on low-interest capital support for green and circular projects...; expanding the subjects and scope of operations of the Small and Medium Enterprise Development Fund; financial support and incentives in contractor selection.
Chapter V: Support for science and technology, innovation, digital transformation and human resource training
Regulations to support scientific research and innovation activities through tax incentives for these activities; the state supports the construction, or leases and purchases of shared platforms.
Support the improvement of corporate governance capacity and human resource quality through the development and implementation of a training program to develop 10,000 executives by 2030.
Chapter VI: Support for the formation of medium and large enterprises and pioneering enterprises
Prescribe 2 policies for this group of enterprises, including: Ordering, limited bidding, and designated bidding to implement key projects of great significance to socio-economic development and national importance.
Support the formation and development of medium and large enterprises and private economic groups of regional and global stature.
Chapter VII: Implementation provisions
The Draft Resolution stipulates the organization of implementation, effective date and handling of the relationship between this Resolution and other relevant Laws and Resolutions.
