Action program to implement innovation in law making and enforcement

(Chinhphu.vn) - The Government has just issued Resolution No. 140/NQ-CP on the Government's Action Program to implement Resolution No. 66-NQ/TW dated April 30, 2025 of the Politburo on innovating law-making and enforcement to meet the requirements of national development in the new era (Program).

Innovation in law making and enforcement to meet the requirements of national development in the new era

By 2025, basically complete the removal of "bottlenecks" caused by legal regulations.

The program aims to institutionalize and fully implement the viewpoints, goals, tasks and solutions set out in Resolution No. 66-NQ/TW of the Politburo on innovation in law-making and enforcement to meet the requirements of national development in the new era (Resolution No. 66-NQ/TW). By 2025, basically complete the removal of "bottlenecks" caused by legal regulations. By 2027, complete the amendment, supplementation and promulgation of new legal documents to ensure a synchronous legal basis for the operation of the state apparatus according to the 3-level government model. By 2028, complete the legal system on investment and business, contributing to bringing Vietnam's investment environment into the top 3 ASEAN countries.

At the same time, identify specific tasks for ministries, branches and localities to develop action plans, organize implementation, inspect, supervise and evaluate the implementation of Resolution No. 66-NQ/TW, realize the goal of building a democratic, fair, synchronous, unified, public, transparent and feasible legal system with a strict and consistent implementation mechanism, ensuring a legal basis for normal, continuous and smooth operations of agencies after reorganizing the apparatus, removing obstacles arising from practice, paving the way for development creation, mobilizing all people and businesses to participate in socio -economic development so that by 2030, Vietnam will be a developing country with modern industry and high average income; by 2045, Vietnam will become a developed country with high income following the socialist orientation.

7 task groups

In order to achieve the goals set out in Resolution No. 66-NQ/TW, in addition to regular tasks, ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and centrally run cities need to specify and organize the implementation of the following 7 groups of tasks:

1. Ensure the comprehensive and direct leadership of the Party in law-making work, and promote Party spirit in law-making and enforcement.

Participate with the Central Propaganda and Mass Mobilization Commission to organize a national conference to study and disseminate Resolution No. 66-NQ/TW under the direction of competent authorities.

Develop, promulgate and implement a Plan for regular and extensive propaganda on the content of Resolution No. 66-NQ/TW in the direction of diversifying communication forms through newspapers, radio, television, digital platforms, social networks and other electronic media; specify propaganda content for each group of people, businesses and authorities at all levels.

2. Innovate thinking and orient the development of laws in a way that both ensures state management requirements and encourages creativity, liberates all productive forces, and unlocks all development resources.

Ensure that the work of law-making must fully, correctly and promptly institutionalize the Party's policies and guidelines; originate from the overall interests of the country; turn institutions and laws into competitive advantages; resolutely abandon the mindset of "if you can't manage, then ban"; promote democracy, respect, ensure and effectively protect human rights and civil rights; ensure the balance and rationality between the level of rights restriction and the legitimate interests achieved. When carrying out the task of law-making, there must be solutions to ensure that the provisions of the law are stable, simple, easy to implement, and center on people and businesses. Properly promote the role of social ethics, professional ethics rules, and community self-management rules in regulating social relations.

Pay attention to and proactively research strategies and policies early, from practice, from world experience to Vietnam's experience, contributing to enhancing predictability and improving the quality of policy and law making.

3. Create breakthroughs in law enforcement, ensure that laws are implemented fairly, strictly, consistently, promptly, effectively and efficiently; closely link law making and enforcement.

There are solutions to promote the spirit of serving the people, the mindset of creating development, and acting for the common interests of the staff, civil servants, and public employees; consistently implementing the viewpoint that people and businesses are allowed to do anything that is not prohibited by law. Promote the role of the Vietnam Fatherland Front, social organizations, and socio-professional organizations in supervising law enforcement.
Prioritize ensuring effective law enforcement to promote socio-economic development, science, technology, innovation, digital transformation and other important areas of public life (food safety, environmental protection, security and safety in cyberspace...).

4. Improve the effectiveness of international cooperation and international law. Develop and improve mechanisms and enhance the capacity of Vietnamese agencies and organizations to ensure full implementation of international legal obligations and shape the international legal order; actively participate in the development of international institutions and laws on the basis of effectively and flexibly utilizing the advantages from the commitments of international treaties to which Vietnam is a member.

Continue to properly handle arising international legal issues, especially international investment and trade disputes, to promptly protect national interests, legitimate rights and interests of individuals, organizations, enterprises, and Vietnamese state agencies.

5. Develop breakthrough solutions to improve the quality of legal human resources. Implement specific and outstanding policies, apply appropriate remuneration and contract regimes to attract and improve the quality of human resources participating in tasks and activities of law making and law enforcement.

Implement mechanisms and policies to extend the working time and not hold positions for a number of cadres and civil servants who have reached the retirement age according to regulations but have high professional qualifications and profound practical experience in law-making. Implement the attraction and reception of experts, legal scientists, jurists and good lawyers into the public sector according to regulations.

6. Strengthen digital transformation, apply artificial intelligence and big data in law making and enforcement.

Prioritize resources for building and developing information technology infrastructure, big data, applying digital technology and artificial intelligence to serve innovation and modernization of law-making and enforcement, ensuring "correctness, sufficiency, cleanliness, liveness", connectivity, ease of exploitation, ease of use, information security and state secrets.

Applying digital technology and synchronous digital transformation in disseminating and educating the law, providing legal aid, and registering security measures; integrating the content of disseminating and educating the law into the "digital learning" movement.

7. Implement a special financial mechanism for law-making and law enforcement. Innovate the mechanism for allocating, managing, and using the budget for law-making on the principle of timeliness, accuracy, and adequacy, and attach spending to the results and products of each task and activity.

The head of the agency assigned with the task of law-making activities has the right to take the initiative and be responsible before the law in allocating, managing and using the assigned funds.
