Special mechanism to attract experts in science, technology, innovation and digital transformation

An important step towards creating a unified legal framework for attracting high-quality intellectuals is the Government's issuance of Decree No. 249/2025/ND-CP stipulating mechanisms and policies to attract experts in science, technology, innovation and digital transformation.

Clear and comprehensive regulations

According to experts, this mechanism is both clear and comprehensive. The Decree stipulates the attraction mechanism and policies, including: criteria; selection process; rights and obligations; responsibilities; evaluation; policies for experts in science , technology, innovation and digital transformation.

This Decree does not apply to Chief Engineers and Chief Architects prescribed in Decree No. 231/2025/ND-CP dated August 26, 2025 of the Government regulating the selection and use of Chief Engineers and Chief Architects on science, technology, innovation and national digital transformation and leading experts and scientists, Chief Engineers prescribed in Decree No. 103/2025/ND-CP dated May 15, 2025 of the Government regulating a number of policies for core defense industrial establishments, core security industrial establishments and regimes and policies for employees in core defense industrial establishments, core security industrial establishments.

In the Decree, the subjects of application are Vietnamese individuals residing abroad and foreigners who meet the criteria for experts specified in this Decree to be nominated, run for election, and selected as experts. Agencies, organizations, and units of the Party, the State, the Vietnam Fatherland Front, central and local socio-political organizations, armed forces, and enterprises are assigned to preside over the implementation of programs, tasks, and projects on science, technology, innovation, and digital transformation.

The specific provisions of the Decree clearly state the criteria for selecting experts. That is, experts are people with knowledge, qualifications, and research experience in one or more fields of science, technology, innovation, and digital transformation.

With the general criteria, presiding over or participating in the implementation of scientific, technological, innovation and digital transformation tasks, prioritizing strategic technology sectors in the list of strategic technologies and strategic technology products issued by competent authorities, making practical contributions to the development of the country, region and the world. At the same time, having a clear background, good ethics; having a desire to contribute to the development of science, technology, innovation and digital transformation in Vietnam.

In addition, the Decree also clarifies that one of the specific criteria must be met, such as: Being the author or co-author of an invention that has been granted a certificate of intellectual property protection and has been applied and transferred to create a product of practical value; or having in-depth expertise and rich experience in the industry or field appropriate to the task performed in Vietnam and currently working in the research department of a research institute, university or reputable enterprise abroad.

Accordingly, they are also the author or co-author of outstanding scientific and technological research works that have won international awards or have been widely applied, bringing practical results and being suitable for the programs, tasks, and projects of science, technology, innovation and digital transformation that they are expected to participate in...

In addition, they must have a doctorate from universities in the top 200 universities in the world according to prestigious international rankings and have at least 5 years of teaching, scientific research, and technology development at prestigious research and training institutions abroad in a major suitable for the program, tasks, and projects of science, technology, innovation, and digital transformation they plan to participate in.

The next criteria is to have a doctorate degree and have at least 5 years of experience working in a scientific research position in an international cooperation program or project on science and technology or in the research department of a reputable enterprise abroad; Have at least 10 international articles published in prestigious journals or be a member of the scientific council of prestigious journals or successfully participate in guiding at least 2 doctoral students.

Many attractive support policies

Experts have the rights and obligations of individuals engaged in science, technology and innovation activities as prescribed in Articles 51 and 52 of the Law on Science, Technology and Innovation.

In addition, based on the requirements of the assigned position, the expert is entitled to exercise a number of rights and obligations stated in the labor contract: To decide on technical and technological issues and resolve technical problems within the scope of assigned tasks; To proactively select and propose competent authorities to mobilize scientific and technological human resources; scientific and technological organizations to participate in performing tasks; To proactively select and use human resources within the scope of assigned tasks; At the same time, to proactively decide on the use of assigned funds and resources, including the use of funds to directly purchase necessary foreign technology, products, equipment, and technological know-how at agreed prices; To be facilitated and supported with funding for surveys and scientific exchanges with foreign scientists to update new technologies.

Salary is agreed upon in the labor contract for experts, ensuring it is commensurate with the assigned tasks and consistent with the salary level in the fields of science, technology, innovation and digital transformation corresponding to the labor market.

Annual bonuses are decided by the agency, organization, or unit assigned to preside over the implementation of programs, tasks, and projects on science, technology, innovation, and digital transformation based on the results of the assessment of the performance of assigned tasks, up to a maximum of 4 months' salary stated in the labor contract.

Bonuses earned from leasing, selling, transferring, assigning the right to use, self-exploiting, using the results of scientific, technological, innovation and digital transformation tasks; results of scientific, technological, innovation and digital transformation tasks when contributing capital, cooperating, joint venture, association, providing services or establishing an enterprise are implemented according to the provisions at Point a, Clause 3, Article 28 of the Law on Science, Technology and Innovation.

At the same time, receive initial support of 1 month's salary stated in the labor contract to stabilize accommodation, travel, and essential purchases. Receive support for house rent, transportation, or provide standard apartments and transportation during the time working as an expert. Receive funding for research and scientific exchange abroad when the agency, organization, or unit presides over programs, tasks, and projects on science, technology, innovation, and digital transformation according to task requirements.

After completing the task, foreign experts who wish to have their conditions reduced when considering granting Vietnamese nationality according to the provisions of law.

Experts with Vietnamese nationality who want to work as civil servants or public employees in agencies, organizations, and units of the Party, the State, and socio-political organizations but do not meet the standards and conditions prescribed by law on civil servants and public employees shall be considered and decided by competent authorities to accept them into the job position; they shall be considered for appointment to leadership and management positions in agencies, organizations, and units of the Party, the State, and socio-political organizations without necessarily ensuring the conditions on age, planned title, political theory level, and consecutive tenure.

The budget for payment of regimes and policies in this Decree is allocated in the budget for implementing programs, tasks, projects on science, technology, innovation and digital transformation. To implement, ministries, central agencies, People's Committees of provinces and centrally run cities are clearly assigned responsibilities./.
