Former FLC Chairman Trinh Van Quyet asked to be tried in absentia due to 'very high risk of death'

On June 17, the High People's Court in Hanoi reopened the appeal trial of defendant Trinh Van Quyet (former Chairman of FLC Group) and related defendants in the case of stock market manipulation and fraudulent appropriation of property.

There were 25 defendants who appealed and the court summoned all 50 defendants in the case to the court. In addition to the defendants who appealed, there were 134 victims and 396 people with related rights and obligations who appealed.

The trial is scheduled to take place from June 17 to 21.

At this appeal hearing, due to his still poor health, former FLC Chairman Trinh Van Quyet submitted a request to be tried in absentia.

The chairman announced the official dispatch of Hospital 198 in response to the detention camp, stating that Mr. Quyet was in a state of extreme fatigue, had difficulty breathing, suffered from many illnesses and was "at a very high risk of death".

According to the hospital's announcement, Mr. Quyet has many impaired functions and is currently taking antibiotics and anti-tuberculosis drugs and needs long-term monitoring at the hospital.

Mr. Trinh Van Quyet's lawyer said that the hospital had predicted that the former FLC chairman's health condition was "very high risk of death" compared to the previous announcement of "high risk of death", so he requested the court to try him in absentia.

Before the above developments, the representative of the prosecutor's office said that this was the third time the appeal hearing was held, the previous two were postponed due to Mr. Quyet's health, so the court was requested to continue the trial.

Before today's appeal hearing, defendant Trinh Van Quyet's wife had paid an additional 1,400 billion VND to the Hanoi Civil Judgment Enforcement Department. Including the previous compensation, the three defendants Trinh Van Quyet and his brothers have fully repaid their civil liability according to the first instance judgment.

Previously, in August 2024, the Hanoi People's Court held a first-instance trial of the case and sentenced defendant Trinh Van Quyet to 21 years in prison for the crimes of Fraudulent appropriation of property and Stock Market Manipulation.

Convicted of the same two crimes, the two younger sisters of defendant Trinh Van Quyet, Trinh Thi Minh Hue and Trinh Thi Thuy Nga, were sentenced to 14 years and 8 years in prison, respectively.

Regarding civil liability, the court of first instance ordered defendant Trinh Van Quyet and his sister Trinh Thi Minh Hue to jointly compensate 1,785 billion VND for the crime of Fraudulent appropriation of property. Divided according to the proportion of responsibility, defendant Quyet must pay 1,369 billion VND, defendant Hue must pay 152 billion VND.

In the case of stock market manipulation, the court of first instance ordered the three defendants Quyet and Quyet brothers to pay 683 billion VND. Of which, defendant Quyet paid 500 billion VND, defendant Hue paid 100 billion VND and defendant Nga paid 83 billion VND.

After the first instance trial, defendant Trinh Van Quyet appealed for a reduction in his prison sentence and consideration of a reduction in civil liability. Defendant Quyet’s two younger sisters also appealed for a reduction in their criminal liability; 22 other defendants appealed for a reduction in their sentences, for suspended sentences, or for the removal of asset freezes…

Before the appeal hearing, in December 2024, the High People's Court in Hanoi held a trial, but the panel of judges later decided to postpone the hearing because defendant Trinh Van Quyet was being treated for many illnesses and could not attend the hearing. Many lawyers and victims also requested a postponement.

On March 25, the High People's Court in Hanoi reopened the trial and continued to postpone the trial due to the health of defendant Trinh Van Quyet, "at risk of death". In addition to health reasons, the defendant's family submitted a petition to the court requesting a postponement of the appeal trial to have conditions to fully remedy the consequences of the case.
