Delegate Bo Thi Xuan Linh gives comments on the draft Law on Road Traffic Order and Safety

BTO-On the afternoon of May 22, the 15th National Assembly, 7th session discussed and commented on the draft Law on Road Traffic Order and Safety. Delegate Bo Thi Xuan Linh - National Assembly Delegation of Binh Thuan province commented on the content of the draft law.

Regarding the revocation of license plates, at Point b, Clause 3, Article 37 of the draft Law stipulates: “In case the vehicle has expired, is damaged or the ownership of the vehicle has been transferred, the vehicle owner is allowed to retain the license plate number for a period of 5 years to register another vehicle under his/her ownership; after the above-mentioned period, the license plate number shall be revoked by the vehicle registration authority, entered into the license plate warehouse for registration and issued to other organizations and individuals according to regulations”. However, at Point d, Clause 6, Article 39 stipulates that in case the motor vehicle has expired according to regulations, the license plate number shall be revoked. Thus, there is no consistency between the above provisions. The Delegate requested that specialized agencies continue to review the above contents.

According to delegate Linh, regarding the auction of vehicle license plates (in Article 38), Resolution No. 73/2022/QH15 dated November 15, 2022 of the National Assembly on the pilot auction of automobile license plates will take effect from July 1, 2023 and will be implemented for 3 years. Therefore, the delegate suggested that after the end of the pilot, it is necessary to analyze, evaluate, and summarize the results of the implementation of the Resolution comprehensively before specifying it in the Law.

In case the provisions on auctioning license plates are still maintained as in the draft Law, Article 38 of the draft should be amended in the direction of only retaining Clause 1 of Article 38 of the draft. The remaining contents of Article 38 such as: determining the starting price; Deposit; rights and obligations of the person winning the license plate auction; Amount of money collected from the license plate auction... should be referred to according to the provisions of the law on the Law on Property Auction and the provisions of the law on the state budget to avoid conflicts and overlaps with the provisions of current law.

Regarding ensuring traffic order and safety for cars transporting students and preschool children (in Article 46), delegates proposed to re-edit Clause 5, Article 46 in the direction of stipulating the responsibility for ensuring road traffic order and safety in organizing the pick-up and drop-off of students and preschool children not only foreducational institutions and the education sector, but also the state management responsibility of agencies, units and localities in this matter.

Regarding the points of the Driving License (in Article 58), to ensure publicity, transparency and create favorable conditions in the implementation process, delegates proposed to add a provision regulating the unification of the connection and sharing of the national database to update and access data on driving license deduction points and notify violators.

Regarding the responsibility for state management of road traffic order and safety (Article 87), it is proposed to supplement the responsibility of the Ministry of Education and Training in educating legal knowledge on road traffic order and safety and coordinate with the Ministry of Public Security to implement state management of road traffic order and safety for the following subjects: preschool children, pupils, students, learners, people working in schools of state agencies, political organizations, socio-political organizations, educational institutions in the national education system, to ensure completeness and compliance with the provisions of Article 7 of the draft Law...
