One of the issues that the National Assembly will question Minister Nguyen Kim Son on is the implementation of legal regulations on extra teaching and learning.
"Do not prohibit extra teaching but must ensure the school'seducational plan"
In recent times, the situation of illegal tutoring and tutoring has continued to be complicated, with many new "transformations". At the end of April, in Ho Chi Minh City, a tutoring class disguised as "beautiful handwriting practice" at Thanh Da Cultural House (Binh Thanh District) was suspended after complaints from the people. The inspection team discovered that some public elementary school teachers had rented a place to teach cultural subjects to about 50 students.
Therefore, the district requested Thanh Da Cultural House to close these classes and not rent the space to teachers to teach. Teachers who violate the regulations on extra teaching will be reported to the school for consideration and handling.
In Hanoi , at the same time, a tutoring center in Dong Da district with nearly 600 students and 29 teachers was closed for violating regulations on information disclosure and fire prevention and fighting safety.
In Ha Dong district, 5 teachers of Van Yen Secondary School were classified as “not completing their duties” for teaching extra classes in violation of regulations. Of these, 3 teachers had signed contracts with the center and reported to the school. However, the teaching location was different from the report. The center explained that it was repairing the facility and temporarily moving to a new location.
The other two teachers have not signed a contract and are both teaching students in their own classes. One claims to be teaching for free, while the other says she is replacing a colleague who is in the hospital.

According to Minister of Education and Training Nguyen Kim Son, although over the past three decades there have been many legal regulations related to extra teaching and learning, this practice is still widespread in many forms.
On February 14, Circular 29 on the management of extra teaching and learning officially took effect. Schools are only allowed to teach extra classes for three groups and must do so free of charge, including: Groups with unsatisfactory results; selected to nurture excellent students; and final year students who voluntarily register for exam review.
For extra-curricular tutoring, individuals and tutoring organizations must register their business and publicly disclose information about tuition fees, duration, etc. In addition, teachers are not allowed to collect extra tuition fees from students in their classes.
According to this circular, extra teaching and learning is "not prohibited", but must ensure that it does not affect the organization and implementation of the school's educational plan, and does not affect the implementation of the subject program and teaching plan of teachers.
In a report on some contents related to the group of questions at the 9th session sent to the National Assembly delegates, the Minister of Education and Training said that the Ministry's viewpoint is to aim for schools without extra teaching, to strengthen and improve the quality of regular school hours, and to create space and time for students to experience, practice, and train through educational activities according to their individual needs for comprehensive development.
“Not teaching your students will avoid a bad reputation for teachers”
Regarding initial results, according to the Minister, Circular 29 has limited the widespread situation of extra teaching and learning. Schools focus on improving the quality of teaching and learning of the main curriculum, ending the practice of paying extra teaching in schools, creating conditions for students to access knowledge without pressure on studying and finances.
For teachers, the regulation that teachers are not allowed to teach the students assigned by the school helps avoid bad reputation for teachers who give legitimate extra lessons, and strengthens the prestige and honor of teachers.
In addition, teachers' awareness of income tax obligations and the value of professional self-improvement has changed. Some teachers even want to completely ban extra teaching both inside and outside of school, because teachers want to have time to rest for their families, and at the same time have time to self-improvement and improve their professional capacity.
However, regarding limitations, Minister Nguyen Kim Son assessed that from 2020, when tutoring and extra learning are no longer conditional business lines, management becomes more difficult, and localities do not know the sanctions to handle violations.
The list of acts requiring administrative sanctions in the education sector currently lacks some violations of regulations on extra teaching and learning that need to be supplemented (currently, localities have proactively based on the sanctions regulations under the Law on Civil Servants and Public Employees and other relevant laws to handle violations)...
In addition, there is still a small number of managers and teachers who, following old habits, do not fully understand the regulations or, for personal gain, when extra teaching gradually becomes an important source of income, still deliberately violate regulations and provide extra teaching under the guise of extra teaching. Meanwhile, some localities have not yet issued regulations on extra teaching and learning according to their authority, leading to confusion in implementation.
The Minister said that extra teaching and learning is a complex issue with great social impact. Therefore, a circular regulating the management of extra teaching and learning cannot solve all the problems. Therefore, it is necessary to have systematic, synchronous, drastic solutions, the implementation needs to have a roadmap, and at the same time, the solutions must be modern.
One of the solutions proposed is that the Ministry continues to propose that the Government include tutoring and learning services in the list of conditional business lines. This is to make tutoring and learning activities transparent, ensure safety for learners, ensure the legitimate interests of teachers, strengthen state management and ensure tax collection for businesses that organize tutoring.
In addition, according to the Minister, localities also need to strengthen inspection and handling of violations, provide financial support to schools to organize review sessions and training for students, contributing to improving the quality of education, especially for students with learning difficulties, final year students, and disadvantaged groups...
