Participating in giving comments, National Assembly Deputy Mai Van Hai, Provincial Party Committee member, Deputy Head of the National Assembly Delegation of Thanh Hoa province basically agreed with the submission and report on the examination of the draft Law on State Budget (amended).

To contribute to perfecting the draft law, delegates would like to add some comments: Clause 12, Article 8 of the principles of state budget management stipulates: "The state budget allocates funds for funds to perform tasks on science and technology development, innovation and digital transformation, and to develop policies and laws according to the provisions of specialized laws, in accordance with the capacity of the state budget".

Delegates basically agreed on the regulation that the state budget allocates funds for science, technology, innovation and digital transformation development funds; the development of policies and laws is appropriate and concretizes the implementation of Resolution No. 57 of the Politburo on breakthroughs in science, technology, innovation and national digital transformation development; Resolution No. 66 of the Politburo on innovation in law making and enforcement to meet the requirements of national development in the new era.

But the delegate suggested that it is also necessary to clarify which funds are responsible for developing science, technology, innovation and digital transformation, and building legal policies and regulations. If it is not clear, it will lead to many funds, and every field needs innovation and development of science, technology, innovation and digital transformation, so the state budget will be difficult to meet and will also be very spread out.

Therefore, the delegate proposed that the State budget should only ensure budget allocation for funds prescribed by the Law on Science, Technology and Innovation, which is being discussed by the National Assembly and will be approved at this Session.

Comments on Article 30: The tasks and powers of the People's Councils at all levels, according to the delegates, the contents that have been reviewed, adjusted and supplemented are quite clear, consistent with the organization of 2-level local government, decentralization to the People's Committee to decide on a number of policies and budget expenditure norms, delegates are very in agreement. However, in addition, it is recommended to reconsider the additional regulations at Point i, Clause 9 "Decision to assign the People's Council at the commune level to issue policies and policies suitable to the development level and capacity of the commune-level budget". Because, after the arrangement of commune-level administrative units, the scale of communes is larger, but the revenue sources outside the central commune, the rural, mountainous, border and island communes will also have many difficulties in revenue sources, unable to balance themselves, most of the communes will also have to receive additional balancing subsidies from the higher-level budget.

Therefore, if the People's Council of the commune has the authority to issue policies and regulations, it will be very difficult to balance the budget to ensure the implementation of the issued policies and regulations. The delegate proposed to remove this task from the People's Council at the commune level.

Participating in giving comments on Clause 2, Article 35, Regulations on revenue sharing and percentage between the central budget and local budget; delegates suggested that it is necessary to review both options as in the draft. Because, the draft law of both options is detailing the percentage of regulation between budget levels in some revenue items, such regulations will be difficult to ensure the long-term stability of the Law. In order to carry out the work of innovation and improve the quality of law making, delegates suggested that the Law only stipulates the revenue items that must be divided by percentage between the central budget and local budget; and stipulates the principles and criteria for division. As for the specific percentage, it should be assigned to the Government to stipulate based on the budget conditions of each period, in accordance with the socio-economic development conditions of the country and of the localities.

Regarding land use fees and land tax according to Resolution No. 18, there needs to be a reasonable regulation mechanism. Delegates suggested that 100% should be left for localities to enjoy at present. Because we are implementing the arrangement of local government according to the 2-level model. When the local government comes into operation, the scale is large, the space for new development is new, and many resources are needed to invest in infrastructure, economy, culture, and society. Meanwhile, when rearranging administrative units, new administrative units will also face many budget difficulties, especially communes in rural, mountainous, and border areas, which still have to depend mainly on the balance from the higher-level budget.

Therefore, it is proposed that the central budget should leave 100% of land use fees and land tax for localities so that localities have resources to invest in infrastructure to promote socio-economic development of localities after the merger. Regarding the division of land use fees, it is proposed to stipulate that land use fees included in the division are after deducting the costs of planning, support, compensation for site clearance, resettlement; infrastructure investment, land use rights auction, bidding for land use projects, etc.
