Proposal to remove standards on training certificates for professional ranks and titles

Requirements for state management qualifications will not specify the standard of having a training certificate according to the standards of professional ranks and titles for leadership and management positions.

The Ministry of Home Affairs is seeking comments on a draft Decree regulating standards for titles of civil servants, leaders and managers in state administrative agencies. Accordingly, the draft stipulates general standards for titles and positions of civil servants, leaders and managers.

Regarding politics and ideology, the draft decree clearly states the moral qualities, lifestyle and sense of organization and discipline for civil servants and leaders. The draft also stipulates qualifications, capacity; prestige and ability to gather and unite; achievements and work results; health, age, work experience; some special cases applying title and position standards when appointing are specified as in the provisions of Regulation No. 350-QD/TW.

Regarding the level of political theory, the draft stipulates 3 specific cases. The criteria for graduating with a bachelor's degree in politics or a senior degree in political theory or a senior degree in political-administrative theory or being certified as equivalent to a senior degree in political theory by a competent authority is applied to titles and positions such as: Deputy Minister, Department Head and equivalent, Deputy Department Head and equivalent, Department Director and equivalent, Head and Deputy Head of Government agencies...

Requirement of graduation from intermediate level of political theory or higher or intermediate level of political-administrative theory or confirmation of equivalent intermediate level of political theory by competent authority applied to titles and positions such as: Head of Department and equivalent of Ministry; Deputy Head of Department and equivalent of Ministry; Head of Department and equivalent of Sub-Department, of regional agency of Department...

The Ministry of Home Affairs proposes not to require political theory qualifications for titles and positions such as: Deputy Head of Department and equivalent of Sub-Department, regional agency under the Department; Deputy Head of Department and equivalent of Sub-Department under the Department; Deputy Head of Department and equivalent of commune level.

Regarding the level of state management, based on the Law on Cadres and Civil Servants 2025, the Law on Public Employees 2025, the draft does not stipulate the standard of having a training certificate according to the standards of professional ranks and titles for leadership and management positions. Instead, the draft stipulates principles such as: Meeting the standards of professional qualifications, science, technology, information technology, foreign languages appropriate to the leadership and management job position according to the regulations of competent authorities.

To suit the actual situation and ensure stability in personnel work, the draft supplements transitional provisions for cases where people holding leadership and management positions have met the standards on political theory and standards on state management as prescribed in Decree No. 29/2024/ND-CP dated March 6, 2024 of the Government stipulating standards for leadership and management positions of civil servants up to the time this Decree takes effect, they do not have to complete the standards on political theory and standards on state management as prescribed in this Decree.

For those holding leadership and management positions who have been appointed to leadership and management positions but have not yet met the standards on political theory and standards on state management as prescribed in Decree No. 29/2024/ND-CP dated March 6, 2024 of the Government stipulating standards for leadership and management positions and titles of civil servants, and are in the process of completing them, they must continue to complete them within 36 months for political theory standards and within 24 months for state management standards from May 1, 2024.

The draft is being consulted until October 30 before being submitted to the Government for approval.
