The draft law adds the concepts of "green technology" and "contactless technology transfer" to align with global trends and practices.

The aforementioned draft law, currently under review by the Ministry of Justice , focuses on six main policy groups aimed at creating incentives, controlling, and enhancing the state's management capacity regarding technology transfer.

Accordingly, the scope of technology assessment has been expanded, not only to investment projects, but also to other cases as required. The concepts of "green technology" and "contactless technology assessment" have been added to align with global trends and practices.

The second policy group focuses on supporting and promoting endogenous technology transfer, including technology transfer between domestic businesses/organizations and individuals, and the commercialization of research and development results. Specifically, regulations on technology transfer rights are clarified, including the establishment, recognition, and protection of technology ownership rights, reducing risks for stakeholders, especially for technologies not registered for intellectual property protection...

Regarding the national technology innovation program and the National Technology Innovation Fund to continue implementing activities supporting technology transfer, including endogenous technology transfer, a completely new provision stipulates that the State shall purchase and disseminate technology for research and application purposes for social and public benefit (such as healthcare ), promote endogenous technology transfer, and develop the supply and demand of technology in the science and technology market.

The fourth policy group focuses on creating financial, institutional, and legal incentives for technology transfer activities. The regulations in Resolution No. 68-NQ/TW of the Politburo on the development of the private economy are institutionalized in Article 35 of the draft law, allowing businesses to include research and development costs at 200% of actual costs as deductible expenses when determining taxable income.

Policies to encourage and incentivize businesses to invest in technology transfer and innovation, based on the level of technology adoption and development (application and operation; mastery and improvement; innovation and development), are also more clearly defined, creating more attractive incentives for businesses to invest in technology transfer and innovation.

The remaining two policy groups are strengthening control over cross-border technology transfer to both control technological security and promote effective international technology transfer, and enhancing state management capacity, monitoring, statistics, and measurement of technology transfer effectiveness. The draft specifically outlines technologies encouraged for transfer, including both from foreign countries to Vietnam and from Vietnam to foreign countries, through tax incentives, credit, and market promotion costs.
