Proposal to maintain the current number of commune-level staff until streamlining is completed

In the draft Law on Cadres and Civil Servants (amended), the Ministry of Home Affairs proposed to add transitional provisions to ensure that the current number of commune-level cadres and civil servants will maintain the same number of positions until the review, streamlining, restructuring and arrangement according to job positions of local authorities are completed.

The number of commune-level cadres and civil servants is over 212,600 people, of which 92.4% have university degrees or higher.

According to the Ministry of Home Affairs , as of December 31, 2024, the number of commune-level cadres and civil servants is over 212,600 people, of which 92.4% have graduated from university or higher and 7.6% have graduated from college or lower.

Accordingly, the number of unqualified commune-level officials and civil servants accounts for only a small percentage and will be resolved according to the policy of ensuring legitimate interests as prescribed by the Government .

Recently, the Ministry of Home Affairs has completed the draft of the revised Law on Cadres and Civil Servants. Of note is the revision of regulations related to cadres and civil servants when organizing local governments at two levels (provincial and communal levels).

To conform to the organization of two-level local government, the draft Law has revised the concept of cadres and civil servants, in which it stipulates cadres and civil servants at the central, provincial and communal levels (removing the district level); at the same time, it removes a chapter on commune-level cadres and civil servants in the current Law on Cadres and Civil Servants.

Accordingly, the draft Law unifies the management of cadres and civil servants from the central to communal levels, without distinguishing between communal and provincial civil servants, ensuring compliance with the Party's policy on interconnectivity in cadre work.

In addition, the draft Law also reviews the regulations on the authority to manage cadres and civil servants in the draft Law to be consistent with the two-level local government organization model (removing the regulations on the authority of the District People's Committee and the Chairman of the District People's Committee).

Current salary is retained until new job is arranged according to Government regulations.

Regarding the transitional provisions, the draft Law stipulates: From the effective date of this Law, commune-level cadres and civil servants as prescribed by the Law on Cadres and Civil Servants 2008 (amended and supplemented by the Law on Amending and Supplementing a Number of Articles of the Law on Cadres and Civil Servants and the Law on Public Employees 2019) shall retain the same number of staff until the review, streamlining, restructuring and arrangement according to job positions of local authorities are completed; and their current salary shall be retained until new jobs are arranged according to Government regulations.

Within 5 years, provinces and centrally-run cities must arrange, streamline and restructure their staff according to the approved job position plan.

The Government shall develop a roadmap and issue regulations for the gradual conversion of management by job position within 5 years from the effective date of this Law. During the 5-year period, the management of the team, the contents of recruitment, management and use of civil servants shall continue to be implemented according to the Government's regulations.
