Di Linh: Proposal to temporarily transfer collective trademarks to the management department

Currently, the communes have not yet decided to form and arrange commune-level administrative units, so the expected handover of management records of certificates of products that have been granted trademark use rights by the Intellectual Property Office is not appropriate.

In addition, the brands all bear the place name Di Linh, which is built and protected according to the geographical indication map and growing areas of all communes and towns in the district. Therefore, handing over to a commune-level unit for management is not suitable for current conditions.

Currently, the People's Committee of Di Linh district has been granted 4 trademark registration certificates by the Intellectual Property Office for 4 products including: Di Linh coffee, Di Linh durian, Di Linh macadamia, Di Linh avocado. The geographical scope of protection is at the district level.

Regarding the Di Linh coffee certification mark, the Intellectual Property Office has granted a certificate since 2009 for the coffee bean product. Therefore, the registration of use by individuals is still limited because in Di Linh district, there are mainly business units that purchase coffee beans and resell them to large export corporations, so the development of Di Linh coffee labeling is facing many difficulties.

The Di Linh Durian, Di Linh Macadamia, and Di Linh Avocado brands have just been granted certificates by the Intellectual Property Office since the end of 2023. The District People's Committee has organized propaganda throughout the district for organizations and individuals to register, but up to now, no unit has applied for the right to use the trademark.

To adapt to the current arrangement of administrative units and organization of two-level local government, the People's Committee of Di Linh district proposed a plan to hand over all records and certificates of the above trademarks to the Department of Science and Technology for centralized management before completing the arrangement of commune-level administrative units. After the merger of commune-level administrative units has been put into stable operation, the Department of Science and Technology will preside over reviewing the practical needs of localities to hand over records and trademark certificates; at the same time, guide the procedures for building maps indicating planting areas, administrative boundary maps, and develop detailed outlines for submission to the Intellectual Property Office to reissue the Certificate of Trademark Registration to ensure compliance with local realities.

In case the option of selecting a new commune after arranging the commune-level administrative unit to temporarily receive the dossier, the current certification mark certificate managed by the district-level People's Committee is unified to be implemented throughout the province, the Di Linh District People's Committee plans to select the Di Linh Commune People's Committee to temporarily hand over the certificate and related dossiers.
