Conditions for licensing to practice clinical nutrition

According to the provisions of Clause 4, Article 11 of Decree No. 155/2018/ND-CP amending and supplementing Decree No. 109/2016/ND-CP, for nutrition clinics, the person responsible for technical expertise who can open a nutrition clinic is a nutrition specialist or a general practitioner with a certificate of training in nutrition or a preventive medicine doctor with a certificate of training in nutrition or a bachelor of nutrition or a doctor of traditional medicine with a certificate of training in nutrition or a bachelor of medicine with a certificate of training in nutrition or a physician with a certificate of training in nutrition.

Ms. Huong asked, can she open a nutrition clinic without a nutrition practice certificate?

Regarding this issue, the Ministry of Health responded as follows:

Currently, the diploma used to obtain a practice license with the scope of clinical nutrition practice is specified in Clause 4, Article 127 of Decree No. 96/2023/ND-CP dated December 30, 2023 of the Government , specifically as follows:

"4. For the title of clinical nutritionist with the scope of clinical nutrition practice:

a) College degree in nutrition, including graduation diplomas granted by foreign educational institutions recognized by the Minister of Labor, War Invalids and Social Affairs as equivalent to college degree in nutrition;

b) Bachelor's degree in nutrition, including a graduation degree granted by a foreign educational institution recognized by the Minister of Education and Training as a bachelor's degree in nutrition;

c) Medical degree as prescribed in Clause 1 of this Article and a certificate of basic specialized training in nutrition".

She has a medical degree so she needs to have a basic specialty training certificate in clinical nutrition to be granted a clinical nutrition scope of practice.

The conditions for granting operating licenses for medical examination and treatment facilities are currently implemented according to the provisions of Decree No. 96/2023/ND-CP dated December 30, 2023 of the Government. The Decrees you mentioned have been abolished by Decree No. 96/2023/ND-CP dated December 30, 2023 of the Government. Specific application is in Articles 39 and 40 of this Decree.
