The National Assembly Delegation of Quang Nam Province solicits comments on the draft Law on Cadres and Civil Servants (amended) and the Law on Teachers.

On April 23, the National Assembly Delegation of Quang Nam province held a conference to collect comments on the draft Law on Cadres and Civil Servants (amended) and the Law on Teachers.

To make the draft laws feasible after promulgation, the Deputy Head of the Provincial National Assembly Delegation suggested a number of contents for delegates to focus on studying and commenting.

Specifically, regarding the Law on Cadres and Civil Servants: to implement the requirements of the Party Central Committee and the Politburo on reorganizing the apparatus of the political system according to the model of organizing two-level local governments; continuing to innovate the work of building and managing the team in a professional, modern, effective, efficient and effective manner, removing difficulties and obstacles in practice; the promulgation of a new Law on Cadres and Civil Servants to replace the current Law on Cadres and Civil Servants is necessary.

This draft revised law consists of 8 Chapters and 54 Articles. It amends and supplements many related regulations such as: salary regime according to job position; rights and obligations of cadres and civil servants; policies to attract talented people to work in state agencies and promote cadres and civil servants with outstanding qualities and abilities in public service; regulations on job positions; abolishment of regulations on civil servant ranks; classification and appointment of civil servants based on corresponding job positions...

Regarding the Law on Teachers: it will codify a system of nearly 200 legal documents regulating policies for teachers, overcoming the dispersion and overlap of current documents, creating transparency, clarity and easy access to regulations on policies for teachers; overcoming public-private inequality in policies for teachers working in the private sector; overcoming shortcomings in applying general policies of civil servants for teachers in the public sector; ensuring unified management of teachers from the central to local levels, synchronizing both public and private, private... to create an environment for teachers to develop and operate effectively.

Delegates speak

At the conference, delegates gave their opinions on the following issues: the State's policy on building and developing the teaching staff; the rights and obligations of teachers; whether the regulation that teachers are not allowed to force students to take extra classes in any form in Clause 2, Article 11 is appropriate or not; should the law include a regulation that teachers are not allowed to teach extra classes to students they directly teach?

Salary, allowance and support policies for teachers; should teacher evaluation be done at the end of the year like civil servants or at the end of the school year; regulations on retirement for teachers, especially the retirement age for teachers in preschools; is retirement at a higher age for teachers in public educational institutions appropriate?

One issue that many delegates are interested in is the regulations on extra teaching and learning. According to Deputy Director of the Department of Education and Training Nguyen Cong Thanh, the Ministry of Education and Training has issued Circular 29 regulating extra teaching and learning.

“After the Ministry issued the regulation, there were many conflicting opinions, so inspections were conducted in many localities. Based on that, Quang Nam widely consulted and then the Province issued Decision 26 regulating extra teaching and learning in the area (the basic content is similar to Circular 29 of the Ministry). In which, there is decentralization of management to communes/wards. If the relevant units fulfill their duties, there will be no more extra teaching and learning in schools. Circular 29 clearly stipulates that “mainstream teachers are not allowed to teach their own students”. Therefore, inspections by competent authorities will be very easy. If Circular 29 is strictly implemented, there will be no more extra teaching and learning in schools”, Mr. Thanh said.

At the conference, delegates also made suggestions to adjust some contents of the two draft laws to suit the practical situation. Among them, there was a recommendation that immediately after the Law takes effect, ministries and branches should promptly issue relevant guiding documents.
