Stop the pilot policy to organize auctions for leasing of food and souvenir stalls

DNO - On October 5, the Management Board of Son Tra Peninsula and Da Nang tourist beaches informed about stopping the pilot policy to organize an auction to lease the food and souvenir stalls in the East Sea Park area and the South of My Hanh restaurant in Phuoc My ward, Son Tra district.

Accordingly, in order to encourage the development of tourism services in some beach areas to serve residents and tourists, based on the proposal of the Department of Culture, Sports and Tourism (Management Board of Son Tra Peninsula and Da Nang tourist beaches), the City People's Committee has agreed in principle to allow the pilot implementation of 10 food and souvenir stalls in the East Sea Park area and south of My Hanh Restaurant in Phuoc My ward from March 2012 to March 2013.

With this policy, businesses and individuals participating in the pilot implementation of 10 food and souvenir stalls were exempted from business premises rental fees during the pilot implementation period because at that time there were no legal regulations on the exploitation and use of public assets in the beach area.

Organizations and individuals participating in the pilot implementation of 10 food and souvenir stalls signed a commitment to the Management Board of Son Tra Peninsula and Da Nang tourist beaches stating: “…self-dismantle the stalls and hand over the premises to the management board within 30 days from the date of receipt of the management board’s notice, if: … Da Nang City People’s Committee has a document to reclaim the premises or move to another location”.

After the city's pilot policy, the Management Board of Son Tra Peninsula and Da Nang tourist beaches handed over the premises to individuals and businesses that registered to participate in the pilot to design and install stalls themselves, carry out business activities, and these businesses and individuals have been exempted from using the business premises (each stall is 75m2) for more than 12 years (March 2012 to September 2024). In addition, the work of ensuring security and order, environmental sanitation, propaganda and promotion of food and souvenir stall business activities has always been supported and handled by the Management Board and related forces and units of the People's Committee of Son Tra District .

Up to now, Pursuant to Law No. 15/2017/QH14 dated June 21, 2017 on management and use of public assets and Land Law No. 45/2013/QH13 dated November 29, 2013 (now replaced by Land Law No. 31/2024/QH15 dated January 18, 2024), in order to manage and use public assets in accordance with regulations to avoid loss and waste, the city has approved the Plan for management, exploitation and public and widespread auction; at the same time, issued a document to terminate the pilot activities, requiring enterprises and individuals participating in the pilot implementation of 10 food and souvenir stalls to hand over the premises no later than September 30, 2024 to organize the auction in accordance with the provisions of law.

In order to implement the city's policy on reclaiming the land to auction the 10 food and souvenir stalls mentioned above, the Management Board of Son Tra Peninsula and Da Nang tourist beaches has repeatedly announced and organized working sessions with businesses, individuals as well as representatives to inform and explain the policy and regulations on public asset management, regulations on auctions related to the policy of stopping the pilot, the benefits that businesses and individuals have enjoyed when participating in the pilot and notify the time of handing over the land according to the city's policy and the commitment signed by businesses and individuals when participating in the pilot.

On October 2 and 3, 2024, the Management Board of Son Tra Peninsula and Da Nang tourist beaches invited representatives of Phuoc My Ward People's Committee and representatives of the Son Tra District Urban Rules Inspection Team to coordinate in inspecting the actual restoration of the food and souvenir counter area at the East Sea Park and south of My Hanh restaurant.

During the inspection, all the stalls had not yet carried out the demolition and site clearance. The management board coordinated with the local authorities to record the scene and continued to visit each stall to persuade businesses and individuals to stop their business activities according to the schedule assigned by the city. Up to now, 3 stalls have agreed to stop their business, 7 stalls have not yet complied with the city's policy.

In the coming time, the Management Board of Son Tra Peninsula and Da Nang tourist beaches will continue to coordinate with the locality to mobilize and request businesses and individuals operating food and souvenir stalls to stop business activities and hand over the premises to organize auctions for leasing premises in accordance with the provisions of law.

In case the remaining businesses and individuals still do not comply with the policy, the management board will report to the Department of Tourism and the City People's Committee to propose assigning competent authorities to organize the compulsory dismantling of food and souvenir stalls on the sidewalk of the East Sea Park and the south of My Hanh restaurant in accordance with regulations to organize a public and widespread auction.
