Residents suggested that the narrow road section (at the back) and the turning radius at two nearly perpendicular locations should be further widened.
According to the petition of more than 10 households in Group 18, Ninh Thuan Hamlet, Bau Nang Commune, Duong Minh Chau District: around 1964, in Group 18 there was a dirt road more than 6m wide starting from the area behind the commune People's Committee headquarters, extending along the current Cuc Lac Thai Binh area to Ninh Phu Hamlet. This was the route for people to circulate and transport goods and agricultural products.
However, since around 2006, Mr. Luong Van Hung’s family (now deceased) built a fence, planted trees, paved the front yard, narrowing a section of the road, making it difficult for traffic. After many comments from local people, Mr. Hung’s family left a diagonal section nearby, although the road was still narrow but temporarily passable.
However, in 2017, the diagonal road was blocked by Mr. Hung's family. The road, which was more than 6m wide, was straightened to the direction of Cuc Lac Thai Binh cemetery, and the road became almost perpendicular at the section adjacent to Ms. Ngo Thi Hong's house. It is worth mentioning that the narrow and straightened road is now only about 2m wide, plus two almost right angles at both ends of the road, making it impossible for cars to pass through.
Mr. Nguyen Trung Manh, a resident whose name is on the petition, said that because the road is unusually narrowed, this section is often flooded during the rainy season. People living nearby continued to complain, and Mr. Hung's family said that the road should be left to the extent that the land use right certificate is granted. In case the residents in the area want to widen the road, they must negotiate with Mr. Hung's family, or only if Mr. Hung's family donates land to widen the road can it be done.
Mr. Trac Minh Hue, also a resident named in the petition, said indignantly: “Here, we do not need to ask Mr. Hung to donate land to widen the road, but we, the people, request the authorities to consider restoring the old road, which is more than 6m wide as before.
The fact that Mr. Hung’s household was granted a land use right certificate including the old road section needs to be reviewed. If there are errors in the process of granting this certificate, it must be revoked to adjust it to the straight, wide, and open road as before. “New rural roads cannot be “bottlenecked” in such a perpendicular manner,” Mr. Hue emphasized.
According to the relevant documents provided by the People's Committee of Bau Nang Commune, on Map 299 there is an old 8m wide dirt road running across Mr. Hung's land. However, according to the diagram of the land plot, house and other assets attached to the land on the land use right certificate issued in 2017 to Mr. Luong Van Hung and Ms. Mai Thi O, the old 8m wide road no longer exists. The old road has been straightened towards Cuc Lac Thai Binh cemetery and leads to the narrow road as mentioned above.
Regarding the content of many people requesting to restore the old road, Mr. Huynh Hung Thoi - Vice Chairman of Bau Nang Commune People's Committee said that after receiving the petition, the Commune People's Committee discussed with representatives of the households that reflected.
Accordingly, people need to stay calm, avoid getting upset, and coordinate with local authorities to carefully understand the content, in order to have a reasonable and appropriate solution. If there is an error in the issuance of the land use right certificate, the State will revoke and adjust it.
According to Mr. Thoi, through searching for the documents granting the land use right certificates to Mr. Hung and Ms. O before, it was shown that the road was located in a different location than the current location, between Mr. Hung's two plots of land. Mr. Hung requested to move the old road closer to the land boundary so that his family could use it more easily (the road adjustment documents in 2016 were related to the two plots of land behind). Currently, on the old road section, a house has been built for Mr. Luong Van Hung's household and the two households behind.
Regarding the upcoming solution, the Vice Chairman of the Commune People's Committee also said that he would encourage Mr. Hung's family to dismantle a section of the fence at the narrow road to create a wider path. Currently, this road is 2m wide, after dismantling it will be 4m wide. The Commune People's Committee will organize an invitation for those named in the petition to meet and discuss and agree on the above solution.
Also a resident named in the petition, Ms. Nguyen Thi Xuan Hoa said that clearing the fence on the narrow road to widen it to 4m still does not solve the problem of cars passing through here. Because at both ends of the narrow road there are still almost right-angle corners.
In any case, it is a matter of neighborhood love, and people can accept not restoring the old road section to its previous position (because it will pass through Mr. Hung's house and two households behind), but it is necessary to further widen the narrow road section and the turning radius at two almost perpendicular locations.
Many households agree with Ms. Nguyen Thi Xuan Hoa's opinion.
