Teacher wins lawsuit, waits miserably for compensation for 3 years

Despite the verdict from 2022, 6 teachers who won the lawsuit in Krong Pak district (Dak Lak) have not yet received compensation.

On May 2, Mr. Tran Quoc Vinh - Chairman of the People's Committee of Krong Pak district - confirmed that the People's Committee of the district had established a working group to advise on the execution of the judgment for 6 teachers who won the lawsuit related to the illegal termination of labor contracts.

The verdict of the winning teacher is clear, but the implementation is… unclear.

However, Mr. Vinh said that because the case was prolonged and involved many agencies, it was "very difficult" to handle and there was still no specific compensation roadmap.

According to records, in 2018, the People's Committee of Krong Pak district decided to terminate contracts with more than 500 teachers due to exceeding recruitment quotas.

6 teachers filed a lawsuit, including 5 people from Nguyen Thi Minh Khai Secondary School (authorizing Mr. Nguyen Anh Duong as representative) and Ms. Nguyen Thi Binh, a teacher at Ea Kly Secondary School.

In April and June 2022, the Dak Lak Provincial People's Court ordered the People's Committee of Krong Pak District and 2 related schools to jointly compensate 6 teachers with more than 2.1 billion VND. Of which, Mr. Duong was compensated nearly 318 million VND, and Ms. Binh more than 175 million VND.

The Civil Judgment Enforcement Office of Krong Pak district issued a decision to enforce the judgment from August 2022, but to date, the obligated parties have not yet implemented it.

The Department has issued at least 7 documents requesting the District People's Committee and 2 schools to coordinate in enforcing the judgment, and at the same time advised the District Civil Judgment Enforcement Steering Committee to hold many meetings to direct the handling.

Most recently, on March 20, the working group met and advised the Standing Committee of the District Party Committee to direct a final resolution. However, the case is still "at a standstill".

On the same day, the Civil Judgment Enforcement Office continued to respond to the third petition of Mr. Duong and Ms. Binh, but still only stopped at the content of "continuing to advise".

Hope to receive compensation soon

For the past 3 years, Mr. Nguyen Anh Duong, a former teacher at Nguyen Thi Minh Khai Secondary School (representing the 4 other teachers who won the lawsuit - PV), has struggled to make a living. After losing his job, he did all kinds of jobs, from construction worker to truck driver.

"We are not asking for anything other than to enforce a legally effective judgment," he said.

Ms. Nguyen Thi Binh could not hide her indignation: "After so many years in the profession, now I am empty-handed, it is difficult to find a job anywhere. If the state agency does not carry out the verdict, who will believe in the law?"

Mr. Duong said that the teachers had repeatedly requested enforcement of the judgment. However, the enforcement agency replied that it could not seize or enforce the property because it involved the state budget.

A leader of the Krong Pak District Party Committee said that the District Party Committee has requested the District People's Committee to urgently handle the matter. In case the district government's term ends and the case is not completed, the file will be handed over to the People's Committee of the commune where the teachers reside for further processing.

Previously, Ms. Ngo Thi Minh Trinh - Vice Chairman of the People's Committee of Krong Pak district (now Chairman of the District People's Council) - said that the district had asked the province for financial support but was refused because "this is the consequence of violations by individuals and organizations in the locality".

According to the inspection conclusion, from 2011-2015, two chairmen of Krong Pak district, Mr. Nguyen Sy Ky and Mr. Y Suon Bya, signed to recruit more than 600 teachers and staff. Both of them and many related officials were later disciplined.

Currently, the district is developing a plan to determine individual responsibility to request compensation reimbursement. However, there is no deadline for assigning specific responsibilities.

7 years of unemployment, 500 teachers still empty-handed

March 9 , 2018 : Krong Pak District announced the termination of contracts of more than 500 teachers due to exceeding recruitment quotas, causing public uproar.

Year 2018 – 2019 : Many teachers complained, some sued the District People's Committee.

Year 2020 – 2021 : Court accepts and adjudicates cases. Teachers wait, making a living by doing all kinds of jobs.

Month 4 and 6-2022 : Dak Lak Provincial People's Court ruled in favor of 6 teachers, forcing the district and two schools to pay compensation of more than 2.1 billion VND.

Month 8-2022 : The judgment is effective but the parties do not comply.

Year 2023 - 2024 : District and schools do not coordinate, execution of the sentence is at a standstill, teachers continue to ask for help.

Month 3-2025 : The district working group met to discuss how to handle the situation, but the case remained at a standstill.

Month 5-2025 : The verdict won nearly 3 years ago has not been enforced. Teachers are left penniless after 7 years of losing their jobs.
