Resolving resettlement difficulties for a series of key projects

(DN) - Dong Nai Province Land Fund Development Center proposed that the Provincial People's Committee continue to assign the Bien Hoa Branch Land Fund Development Center to receive, monitor, manage and coordinate with the People's Committees of 9 wards in resettlement arrangement work to speed up the progress of a series of projects, including many key projects.

Dealing with the situation of "both surplus and shortage" of resettlement land

Tran Bien Ward is the central ward of the province, therefore, there are currently a series of key projects and works being implemented in the area. Recently, the progress of most projects has been delayed, the main reason being problems in site clearance.

According to Vice Chairman of Tran Bien Ward People's Committee Pham Duc Hoang: In the ward, there are key projects and works that are facing difficulties in site clearance. In particular, the biggest "bottleneck" is the resettlement arrangement for households whose land has been recovered to implement projects. Particularly at the Cai River Road Project, there are currently hundreds of households waiting to be arranged for resettlement.

According to the Dong Nai Province Land Fund Development Center, according to Clause 5, Article 86 of the Land Law, it is stipulated that: Land recovered under the provisions of Article 87 and Article 79 of this Law but not yet assigned or leased for use in urban areas shall be assigned to land fund development organizations for management, exploitation and use; in rural areas, it shall be assigned to the People's Committees at the commune level for management.

Explaining this situation, Mr. Pham Duc Hoang said: Previously, when implementing projects, the resettlement plan was to arrange resettlement for households in resettlement areas in the old Bien Hoa city. However, since the implementation of the 2-level local government model, many resettlement areas are no longer located in the ward but in other wards.

According to the new regulations, Tran Bien ward cannot approve resettlement arrangements for households in the project areas in the ward to resettlement areas in other wards as a basis for approving compensation and support plans. Therefore, resettlement arrangements encounter many difficulties, affecting the progress of site clearance for projects.

This is also a common problem for the other 8 wards rearranged on the basis of the administrative boundaries of the old Bien Hoa city.

According to Mr. Chu Tien Dung, Deputy Director of the Provincial Land Fund Development Center: According to the provisions of Point k, Point m, Clause 1, Article 14 and based on Point a, Clause 1, Article 17 of Decree 151/2025/ND-CP dated June 12, 2025 of the Government regulating the division of authority of local authorities at 2 levels, decentralization and decentralization in the field of land, land management at the local level is managed by the competent land management agency at the commune level.

However, there are problems and shortcomings in allocating resettlement land funds according to this regulation. Specifically, localities with resettlement land funds will only assign resettlement land to projects in that ward or commune for management. This leads to a situation where localities have many resettlement land funds and many resettlement areas but few land acquisition projects, so there is no need to allocate them. Meanwhile, localities with few resettlement land funds but many projects that must acquire land will lack resettlement land funds.

Based on that reality, in early September 2025, the Land Fund Development Center of Dong Nai province proposed to the Provincial People's Committee a solution to remove obstacles to this problem.

Accordingly, the Dong Nai Provincial Land Fund Development Center proposed that the Provincial People's Committee continue to assign the Bien Hoa Branch of the Land Fund Development Center to receive, monitor, manage and coordinate with the Ward People's Committees in arranging resettlement for the previous resettlement areas. This is to ensure the progress of disbursement of public investment capital as well as the arrangement of resettlement for projects previously allocated by the People's Committee of the old Bien Hoa city is continuous and uninterrupted.

Proposal to quickly process construction procedures for 4 resettlement areas

According to the Land Fund Development Center of Dong Nai province, currently, the Bien Hoa branch of the Land Fund Development Center is carrying out land recovery and site clearance for about 40 projects in 9 wards including: Tran Bien, Bien Hoa, Trang Dai, Tam Hiep, Ho Nai, Long Binh, Long Hung, Phuoc Tan and Tam Phuoc.

According to calculations, the resettlement demand for these projects is nearly 2,400 resettlement plots and 501 social housing units.

Meanwhile, the vacant land fund for resettlement in the resettlement areas in 9 wards is about 386 plots of land. However, these plots of land are scattered in the wards and are not suitable for the land acquisition area for project implementation, so people have not agreed with the resettlement arrangement plan. This causes great difficulty in implementing the work of mobilizing people whose land is acquired to hand over the site.

To address the urgent need for resettlement, especially for key projects, the Dong Nai Provincial Land Fund Development Center recommends that the Provincial People's Committee direct the relevant agencies to urgently submit and appraise legal documents on planning to implement infrastructure construction for 4 resettlement areas including: 3-hectare resettlement area in the old Binh Da ward, now Tam Hiep ward; Tam Hiep ward resettlement area; 6.3-hectare Buu Long commercial and resettlement residential area and resettlement residential area in the old Hiep Hoa ward, now Tran Bien ward.
