Comments on the Draft Documents of the 14th National Party Congress: A new and important development in the Party's theoretical thinking

The addition of “theory on the renovation path” to the Party’s ideological foundation is correct, necessary and objective. This is a new and important step in the Party’s theoretical thinking after the revolutionary stages of creatively applying Marxism-Leninism and comprehensively implementing Ho Chi Minh’s thought.

The Draft Document Editorial Board has selected 18 important issues in the Draft Documents to be submitted to the 14th National Party Congress. All 18 selected issues and many others are of great concern, including 3 "hot" issues.

Supplementing "theory on innovation" is a component of the Party's ideological foundation.

This is an inevitable and objective issue. Summarizing nearly 40 years of implementing the renovation process, our Party has drawn many important lessons, including the basic content of the renovation policy; the guiding ideology of the renovation process (economic development is the center; Party building is the key; cultural and human development is the spiritual foundation; ensuring national defense and security is important and regular); and the principles of the renovation policy (including the principles: maintaining the goal of national independence and socialism; closely combining economic and political renovation; combining national strength with the strength of the times; comprehensive and synchronous renovation but must have appropriate steps...).

All are under the absolute and comprehensive leadership of the Party. The results and lessons of innovation are closely linked to Marxism-Leninism and Ho Chi Minh's thought. Innovation is a process and does not stop at any point in the revolutionary process. Therefore, adding "theory on the innovation path" to the Party's ideological foundation is correct, necessary and objective. This is a new and important development step in the Party's theoretical thinking after the revolutionary stages of creatively applying Marxism-Leninism and comprehensively implementing Ho Chi Minh's thought.

Thus, according to the Draft Political Report and in Section III of the Draft Report summarizing 15 years of implementing the Party Charter (2011 - 2025) and proposing and guiding the supplementation and amendment of the Party Charter , it is necessary to affirm that "The Communist Party of Vietnam firmly adheres to Marxism-Leninism, Ho Chi Minh thought and the theory of renovation as the ideological foundation and guideline for all activities of the Party".

Regarding Section XIII of the Draft Political Report - Continuing to promote the building and perfecting of the Socialist Republic of Vietnam's rule of law state

This section has 8 paragraphs: Paragraph 1 is the general introduction about the completion of the state apparatus. Paragraph 2 is about the National Assembly (legislative body). Paragraph 3 is about the Government, ministries, and branches (executive agencies at the central level). Paragraph 4 is about the working relationship between government levels; decentralization, delegation of power, and operation of the two-level local government (executive agencies at the local level). Paragraph 5 is about the Court and the People's Procuracy. Paragraph 6 is about the continued completion of the legal system. Paragraph 7 is about the construction of the state management and national governance system. Paragraph 8 is about the development of cadres, civil servants, and public employees at all levels.

In my opinion, it is more reasonable to attach paragraph 6 to paragraph 2 (except the last sentence of paragraph 6), because the construction and completion of the legal system is completely in line with the functions and tasks of the National Assembly, in line with the tasks of the National Assembly Standing Committee as stipulated in Clause 2, Article 74 of the 2013 Constitution as "...interpreting the Constitution, laws, and ordinances".

After merging, there will be 7 remaining paragraphs, in which the paragraph about the National Assembly is continuous as follows: “Continue to build the National Assembly to truly be the highest state power agency, representing the will and aspirations of the people; promote the spirit of democracy, rule of law, modernity, professionalism, science, publicity, transparency, effectiveness and efficiency in the organization and operation of the National Assembly, decide on important issues of the country, exercise supreme supervision over the activities of the State; promote the role and responsibility of the National Assembly Standing Committee in explaining the law. Innovate thinking, perfect the method and process of law-making to ensure professionalism, science, timeliness, effectiveness, meeting the requirements of rapid and sustainable development of the country in the new era. Continue to perfect the legal system to be complete, synchronous, unified, fair, democratic, transparent, feasible and stable to create a foundation for a modern management and governance system, promote innovation and development in all fields. new areas, promptly remove difficulties and obstacles; arouse and promote all potentials, strengths and resources, creating new momentum for the country's rapid and sustainable development".

The last sentence of paragraph 6 has two ideas: "Strictly and effectively implementing the law" and "guiding the application of the law, ensuring the understanding and consistent application of the law", so it would be more reasonable to put it in paragraph 3 to talk about the Government.

In paragraph 5, talking about the People's Court and the People's Procuracy, there is the term system in the sentence "Continue to improve the functions, tasks and effective and efficient operations of the People's Court system ...". If the People's Court is considered a system, it is easy to misunderstand that, as a system, the higher Court has the right to direct the lower Court, including the trial. Understanding it like that will contradict Article 6 of the Law on the Organization of People's Courts, which is independent according to the trial authority . Therefore, the above sentence can be revised as follows: "Continue to improve the functions, tasks and effective and efficient operations of the People's Courts at all levels...".

I also review this section as well as the entire Draft Document to unify in which cases the noun "people" is capitalized and in which cases it is not. In our opinion, in documents from the 2013 Constitution up to now, the word "people" must be capitalized as in the Constitution with the meaning of honoring the people. From 2013 onwards, if quoted, it must be kept as the original.

Focus on building a team of cadres at all levels, focusing on strategic levels, especially leaders.

At Point 2.7 - Strongly innovate the work of cadres... The draft is very progressive and has many innovations. That is, the selection mechanism and the screening mechanism go hand in hand. The basic content of the selection mechanism is 6 enough (enough virtue, enough talent, enough heart, enough range, enough strength and enough enthusiasm). Previously, only "virtue and talent" were talked about a lot, in which virtue is the root. Perhaps for the first time, health is set as a standard. That is completely correct. Having 6 enough to work effectively, the leader will have prestige and with prestige, he will be able to lead.

One of the criteria for evaluating cadres is the "product" they produce. The products of leaders and managers are harder to see than those in production and business, but they are not impossible to determine. For a long time, promotions, appointments, and appointments have basically been based on work results. The work results listed are the "catalogue" of products...

The Drafting Committee is requested to consider the following issues:

People doing personnel work (especially leaders) must have knowledge of organizational structure and personnel; and working in any field, they must know the expertise and profession of that field . Because only by understanding the principles of organizational structure, people and work can they arrange, assign and transfer correctly and reasonably; it is necessary to avoid the situation that Uncle Ho mentioned, where the blacksmith is asked to make cabinets, the carpenter is asked to forge knives, resulting in both of them failing. People doing organizational and personnel work (especially leaders) must be people with "quality of quality, purity of purity, integrity of integrity; honesty of honesty and fairness of fairness". The leader must be a person with "high talent, high virtue" and high credibility.

Regarding comments and evaluation of cadres: It is recommended to restore the evaluation method of the 9th Party Congress term. That is, qualitative and quantitative evaluation, by evaluating according to the achieved criteria. Quality (virtue) includes 4 criteria; capacity (talent) includes 6 criteria. Each criterion corresponds to a number of points. A total of 10 criteria is 100 points. The excellent level must have a score from 90 to 100 points; Completing the task is from 50 to under 90 points; not completing is under 50 points. In addition to the text, there is a specific illustration by quantifying the score. This will avoid the situation of comments being general and being the same.
