Continuing the 46th session, on the morning of June 4, under the direction of Vice Chairman of the National Assembly Le Minh Hoan, the National Assembly Standing Committee (NASC) gave opinions on receiving, explaining, and revising the draft Law on Chemicals (amended).

Presenting a report on this issue, Chairman of the Committee for Science , Technology and Environment Le Quang Huy said that the revised draft law consists of 7 chapters and 48 articles, removing 4 articles compared to the draft law submitted to the National Assembly on May 8, 2025.

One of the important revisions, according to Mr. Le Quang Huy, is not to stipulate the contents related to corporate income tax; investment incentives; list of conditional investment and business sectors and occupations in this draft law. At the same time, the drafting agency and the reviewing agency of the above draft laws have been and are continuing to request the drafting agency and the reviewing agency of the above draft laws to revise and supplement the above contents in related laws to ensure consistency and synchronization in the legal system.

In addition, Chairman Le Quang Huy stated that the misuse of some chemicals has caused serious consequences for human health, social order and safety, causing outrage among voters and people, especially activities such as buying, selling, and using cyanide compounds for the wrong purposes and using nitrous oxide ( N2O - laughing gas) for entertainment purposes...

Therefore, to strengthen the management of toxic chemicals and control risks of chemical safety and security, the draft law has amended and supplemented a number of regulations, specifically the management of chemicals throughout their entire life cycle; inspection measures for the import of chemicals requiring special control, chemical storage services requiring special control; application of digital technology and digital transformation in controlling the purchase and sale of chemicals requiring special control (accordingly, data on purchase and sale activities will be authenticated with data on organizations and individuals purchasing and selling according to the implementation roadmap prescribed by the Government).

“Organizations and individuals using chemicals requiring special control must register the purpose and need for using the chemicals on the database, especially post-inspection work to minimize the misuse of chemicals; chemical trading organizations are only allowed to sell chemicals requiring special control to organizations and individuals that have declared the type of chemical and the purpose of use on the Chemical Specialized Database,” the head of the Committee for Science, Technology and Environment emphasized.

According to Mr. Le Quang Huy, in the spirit of innovation in law-making, the draft law does not specifically stipulate the division of state management among ministries and localities, but this is regulated by the Government based on the provisions of the Law on Organization of the Government.

“However, currently, a chemical can be used in many different fields, managed by many ministries; this can easily lead to a situation where businesses dishonestly declare the purpose of use in order to choose a more open mechanism,” the representative of the inspection agency raised the issue. This is also the concern of the Head of the Delegation Work Committee Nguyen Thanh Hai.

Ms. Nguyen Thanh Hai noted that there are chemicals that are very necessary for some legitimate purposes, but if used for the wrong purposes, the consequences are very serious. "Imported apples that do not spoil after a few months must have been soaked in preservatives, so where is the responsibility? When delegating authority, what does the leading ministry or agency have the right to request and recommend other ministries or agencies to do?", Head of the Committee Nguyen Thanh Hai stated.

Vice Chairman of the National Assembly Nguyen Khac Dinh and Vice Chairman of the National Assembly Tran Quang Phuong noted that there are toxic chemicals that exist in nature, not man-made products, such as “acid rain”. Will this draft law regulate them? What are the solutions to handle them?

National Assembly Chairman Tran Thanh Man noted that the draft law needs to be reviewed, written more concisely and strictly, with special attention paid to considering prohibited acts, ensuring a longer "lifespan" of the law.
