
This content is shown in the Report on the Results of Collecting Opinions within the Vietnam Fatherland Front System on the Draft Resolution amending and supplementing a number of articles of the 2013 Constitution of the Socialist Republic of Vietnam signed and issued by Vice President Hoang Cong Thuy on behalf of the Standing Committee of the Central Committee of the Vietnam Fatherland Front.
Based on the synthesis of opinions and recommendations, the Standing Committee of the Central Committee of the Vietnam Fatherland Front proposes to absorb and revise the draft Resolution as follows:
Regarding the Vietnam Fatherland Front and socio -political organizations (amended and supplemented content of Article 9 of the 2013 Constitution) : The Standing Committee agreed and proposed to keep the amended and supplemented content in Clause 1, Article 9 of the 2013 Constitution of the draft Resolution, which has inherited most of the provisions that remain valid;
Only adding some contents that have been recorded in the Platform for national construction in the transitional period to socialism (supplemented and developed in 2011) The Vietnam Fatherland Front is a part of the political system, the political foundation of the people's government. The Communist Party of Vietnam is both a member and leader of the Front; in accordance with the provisions of Article 4 of the 2013 Constitution.
At the same time, the 13th National Party Congress Document determined to implement the method of "The Party leads, the State manages, the Fatherland Front and socio-political organizations act as the core for the people to be masters"... Therefore, Clause 1, Article 9 of the Constitution adds the content "expressing the will and aspirations of the People and promoting the people's mastery" is necessary and appropriate.
Regarding the amendment and supplement in Clause 2, Article 9 of the 2013 Constitution in the draft Resolution: Agree and propose to maintain the provisions on socio-political organizations under the Vietnam Fatherland Front. In addition, propose to accept comments on replacing the phrase "under the leadership of the Vietnam Fatherland Front" with the phrase "chaired by the Vietnam Fatherland Front".
The Standing Committee agreed and proposed to keep the phrase "directly under" in Article 10 to be consistent with the amendment and supplement to Clause 2, Article 9 of the 2013 Constitution in the draft Resolution, ensuring consistency in the provisions of the Constitution.
The Standing Committee unanimously accepted the comments to add the phrase "solely" and make it the regulation "the sole representative of workers at the national level" to clearly affirm the position of the trade union in representing workers at the national level in "labor relations" and in "international relations on trade unions".
The Standing Committee unanimously accepted the comments and adjusted the provisions in Clause 1, Article 84 in the direction of retaining the right to submit draft laws and ordinances of central agencies of socio-political organizations. Accordingly, the provisions in Clause 1, Article 84 state: “The President, the National Assembly Standing Committee, the Nationalities Council, the National Assembly Committees, the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit, the Central Committee of the Vietnam Fatherland Front, and central agencies of socio-political organizations have the right to submit draft laws to the National Assembly and draft ordinances to the National Assembly Standing Committee.”
Regarding the content of amending and supplementing Article 110 of the 2013 Constitution , the Standing Committee proposed to continue to retain the provision "must consult local people" in Clause 3, Article 110 of the current Constitution to ensure full expression of the people's mastery because the establishment, dissolution, merger, division of administrative units, and adjustment of administrative unit boundaries are very big issues, directly affecting people's lives.
In particular, from synthesizing opinions from experts, scientists and localities, the Standing Committee proposed to carefully study the retention of administrative units below the province such as towns, provincial cities and townships, in order to ensure the promotion of the value of urban areas formed over many years, associated with historical factors, traditions and current urban development requirements.
Regarding the right of People's Council deputies to question the Chief Justice of the People's Court and the Chief Prosecutor of the People's Procuracy, the Standing Committee proposed to continue to regulate the right of People's Council deputies to question the Chief Justice of the People's Court and the Chief Prosecutor of the People's Procuracy (as in Clause 2, Article 115, Constitution 2013). In addition, it is proposed to add the subject of questioning the Chief Justice of the Regional People's Court and the Chief Prosecutor of the Regional People's Procuracy to ensure the people's comprehensive supervision of these positions from the central to local levels.
