Intelligence is understood as the ability to think and act using knowledge, experience, understanding, common sense and human insight. The assessment of an individual's intelligence cannot be done through degrees but through each person's ability to maintain creativity.

Intelligence is considered as a form of property invented by individuals or organizations to create material or spiritual values ​​that benefit individuals in particular and society in general. It is the result of the process of research, creation, investment of effort and money of individuals and organizations to create their own works.

In developed countries, intangible assets account for over 80% of value, and in the US alone, over 90% of the S&P 500 group of businesses (the largest and most prestigious companies in the US).

According to the Ministry of Science and Technology , intellectual property (IP) is becoming a strategic tool to protect, dominate technology and compete internationally. Global businesses consider inventions as "soft weapons" to control the market, while investment in intangible assets is increasingly superior to tangible assets.

Many countries have developed models of intellectual property exploitation, converting intellectual property rights into money through valuation, transfer, licensing, and trading on the stock exchange. This trend has shifted corporate governance from "rights management" to "asset management", while the Government focuses on supporting the effective valuation, use, and protection of intellectual property.

The draft Law amending and supplementing a number of articles of the Law on Intellectual Property is considered necessary to concretize the Party's policies, ensure consistency in the legal system, and at the same time meet the requirements of innovation, digital transformation and international integration.

The project focuses on five major policy groups, including: supporting the commercial exploitation of intellectual property rights through perfecting the concept, supplementing policies on pricing, transfer, capital mobilization and encouraging the development of intellectual property ecosystems for start-up businesses; Simplifying administrative procedures, shortening application processing time, developing online public services and investing in digital infrastructure; Improving the effectiveness of intellectual property rights protection by expanding the scope of infringements that can be handled, increasing sanctions, supplementing measures to protect rights in the digital environment and regulating the responsibilities of intermediary service providers; Ensuring the implementation of international commitments through adjusting the objects of protection and the scope of handling infringing goods; Updating new trends in technology and innovation.

The 10th session of the 15th National Assembly has many important contents, including reviewing the Law amending and supplementing a number of articles of the Law on Intellectual Property.

According to the draft, intellectual property rights that have not been recorded in the enterprise's accounting books will be self-valued by the owners, compiled into an asset list for management and used as a basis for commercial transactions, capital contributions and capital mobilization. The Government will build a national database on the value of rights that have been legally traded, and at the same time provide guidance on valuation methods for businesses and individuals to refer to.

At the same time, policies will be piloted such as allowing loans to be secured by intellectual property rights, mobilizing capital through the stock market or developing insurance products and new financial instruments.

The draft Law amending and supplementing a number of articles of the Law on Intellectual Property is expected to create a modern legal corridor, improve the effectiveness of protection and exploitation of intellectual property values, thereby contributing to promoting innovation, digital transformation and international integration. The draft Law is expected to be submitted to the National Assembly for discussion and approval at the 10th Session.
