8 defendants prosecuted in the case of illegal rare earth mining at Thai Duong Group

On the afternoon of January 5, the Ministry of Public Security announced: On January 4, the Ministry of Public Security's Investigation Police Agency issued Decisions to prosecute 08 subjects in the case of Violating regulations on research, exploration, and exploitation of natural resources, Violating regulations on accounting causing serious consequences, and Smuggling occurring at Thai Duong Group Joint Stock Company, Vietnam Rare Earth Joint Stock Company and related units.

Expanding the investigation of the case of Violating regulations on research, exploration, and exploitation of natural resources, Violating regulations on accounting causing serious consequences, and Smuggling occurring at Thai Duong Group Joint Stock Company, Vietnam Rare Earth Joint Stock Company and related units according to Decision on initiating criminal proceedings No. 39/QD-CSKT-P3 dated October 17, 2023 and Decision supplementing Decision on initiating criminal proceedings No. 25/QD-CSKT-P3 dated November 27, 2023. Based on collected documents and evidence, on January 4, 2024, the Investigation Police Agency of the Ministry of Public Security issued Decisions and Prosecution Orders against related subjects including:

1. Prosecute and issue an arrest warrant for temporary detention against (1) Liu Dehua (Chinese nationality), (2) Vu Thi Tuyet, (3) Tran Duc, Director and (4) Tran Nhu Hoang, Employees of Duong Lieu Logistic Company Limited; prosecute and prohibit from leaving the place of residence (5) Nguyen Thanh Doan, Director of Truong Son War Invalids Joint Stock Company for the crime of "Smuggling" as prescribed in Clause 4, Article 188 of the Penal Code for organizing processing, disguising, concealing, and fraudulently carrying out customs procedures to illegally export to China a quantity of rare earth worth VND 7,850,498,000;

2. Prosecute and issue an arrest warrant for (6) Nguyen Anh Son, Director of Son Anh Phu Tho Trading Company Limited; prosecute and prohibit from leaving the place of residence (7) Doan Hai Nam, Head of the Materials Department, Hoa Phat Hai Duong Steel Joint Stock Company and (8) Do Khanh Toan, Deputy Director of Atexim Company Limited for the crime of "Violating accounting regulations causing serious consequences" as prescribed in Clause 3, Article 221 of the Penal Code; for assisting the defendant Dang Tran Chi, Director of Hop Thanh Phat Transport Trading Company Limited, in violating the provisions of the law on accounting, causing a loss of VND 8,786,402,073 in tax money to the State. After the Supreme People's Procuracy approved, the Investigation Police Agency of the Ministry of Public Security executed the Decisions and Procedural Orders against 07 defendants in accordance with the law; As for the defendant Andy Lau, he has left the country and returned to China, so the Investigation Agency will carry out wanted procedures according to regulations.

Currently, the Ministry of Public Security's Investigation Police Agency is focusing on investigating and clarifying the nature, roles, and criminal acts of the defendants and related subjects to expand the investigation, clarify the nature of the case, and thoroughly recover assets for the State./.
