Prosecution of the case of “manufacturing and trading counterfeit goods” at EBC Dong Nai Medical Factory Joint Stock Company

On May 29, the Investigation Police Agency, Dong Nai Provincial Police issued a Decision to prosecute the criminal case of "manufacturing and trading counterfeit goods" occurring at EBC Dong Nai Medical Factory Joint Stock Company for investigation and handling according to regulations.

This is a serious case that has attracted public attention. Therefore, the Investigation Police Agency and Dong Nai Provincial Police are focusing on investigating and clarifying the responsibilities of related organizations and individuals.

EBC Dong Nai Medical Factory Joint Stock Company cooperates and produces for VB Group Trading and Service Company Limited, located at Mezzanine Floor, Dai Thanh Binh Building, No. 911-913-915-917, Nguyen Trai, Ward 14, District 5, Ho Chi Minh City, Hanayuki Sunscreen Body sunscreen product.

According to the quality standards file, the product has been registered with the sunscreen ingredient listed on the packaging as SPF 50. However, the test result No. 0027/VKN-KTMP2025 dated April 28, 2025 of the Ho Chi Minh City Drug Testing Institute for the Hanayuki Sunscreen Body sunscreen product, sampled directly at EBC Dong Nai Medical Factory Joint Stock Company, the SPF index is 2.4, only 4.8% compared to the registered index and listed on the product packaging.

Pursuant to Point b, Clause 7, Article 3 of Decree No. 98/2020/ND-CP dated August 26, 2020 of the Government, the above sunscreen product has a quantity of the main substance (SPF) that creates the value of use and function of the goods of less than 70%, and is determined to be counterfeit.

In terms of quantity, the batch of goods that EBC Company produced and transferred to VB Group Trading and Service Company Limited for sale to the market was 1,652 products, with a unit price of VND 99,000/product, equivalent to a total value of more than VND 163 million, showing signs of the crime of "Production and trading of counterfeit goods", stipulated in Clause 2, Article 192 of the 2015 Penal Code.
