Maintain discipline
Reality in Phu Yen shows that in recent years, the enforcement of civil judgments (CJJ) and administrative judgments (ADJJ) has changed positively, many complicated and prolonged cases have been resolved, contributing to maintaining security and order and promoting local socio-economic development. However, in the area, there are still cases pending, cases with conditions for enforcement but not yet completely resolved; the enforcement of some administrative judgments is still slow or not thorough. Some localities have not paid due attention to the work of direction, management and coordination; the qualifications and sense of responsibility of a number of cadres are still limited...
Faced with that situation, the Provincial People's Procuracy has promoted the role and function of the Procuracy in comprehensively supervising the activities of THADS and THAHC. In particular, in 2024, as an advisory body, the Provincial People's Procuracy chaired and coordinated with relevant units to advise the Provincial Party Standing Committee to issue Directive 41-CT/TU dated March 27, 2024 on strengthening the Party's leadership over THADS and THAHC work in the province.
Based on Directive 41-CT/TU, along with the continuous efforts of the two-level People's Procuracy and the drastic participation of the entire political system, the work of civil judgment enforcement and administrative judgment enforcement in Phu Yen has increasingly changed positively, contributing to building an honest judiciary, serving the people.
Directive 41-CT/TU is an important institutional milestone, demonstrating the political determination of the Provincial Party Committee in tightening legal discipline and improving the effectiveness of judgment enforcement. The Directive requires Party committees and authorities at all levels to strictly implement the central direction on civil judgment enforcement and administrative judgment enforcement; link judgment enforcement with socio-economic development, national defense and security; strengthen the supervisory role of the People's Council, the Fatherland Front, and mass organizations; the Provincial People's Committee focuses on thoroughly handling pending cases, especially those related to land and housing. At the same time, clearly assign responsibilities to the sectors: the Procuracy strengthens supervision, promptly protests violations; the court issues clear and easy-to-execute judgments; the police support enforcement and handle opposition; the enforcement agency improves management, builds a team of integrity...
Regarding this issue, Mr. Pham Trung Thuan, Director of the Provincial People's Procuracy affirmed: "Directive 41 not only strengthens legal discipline but also creates clear changes in recovering corrupt and economic assets; at the same time, better protects the legitimate rights and interests of organizations and individuals in the spirit of judicial reform".
Synchronous, drastic and effective supervision
According to the Provincial People's Procuracy, in the first 6 months of 2025, the People's Procuracy at two levels has synchronously deployed inspection methods, focusing on key stages of enforcement activities. The People's Procuracy has closely coordinated with the THADS agency, the Standing Committee of the Vietnam Fatherland Front Committee and the People's Council at the same level to monitor the implementation of the law, especially in complicated and prolonged cases. The inspection contents focus on the process of asset seizure, enforcement, valuation, consideration of exemption from enforcement obligations, destruction of evidence and settlement of complaints and denunciations. Thereby ensuring that all enforcement activities are carried out in accordance with the provisions of law, without negativity or procedural violations.
On that basis, the People's Procuracy directly inspected 7 cases at the THADS agencies, inspected 2 files with signs of violations and issued conclusions on both cases. At the same time, the People's Procuracy also inspected 161 cases related to seizure, enforcement, destruction of evidence, and handover of assets; inspected 4,005 decisions on enforcement of judgments; directly verified the conditions for enforcement of judgments in 32 cases. Through the inspection work, the People's Procuracy issued 15 recommendations requesting THADS agencies and related units to remedy violations, of which 14 recommendations were accepted and 1 recommendation is within the response period; at the same time, issued 1 notice to draw experience for the whole industry.
Director of the Provincial People's Procuracy Pham Trung Thuan said: The work of supervising THADS and THAHC not only aims to ensure that the law is strictly enforced, but also contributes to strengthening people's trust in justice and the role of judicial agencies in protecting the rule of law. Promoting the achieved results, in the coming time, the Phu Yen Procuracy will continue to strengthen the supervision of high-value and complicated cases related to land and public assets; closely coordinate with the enforcement agency, the Vietnam Fatherland Front and organizations to monitor and propose solutions to shortcomings in the enforcement practice.
