Checking compliance with legal regulations in real estate business activities

Khanh Hoa Department of Construction has just issued a plan to inspect compliance with legal regulations in real estate business activities in the province.

Accordingly, the department will conduct surprise inspections and by invitation of real estate trading floors, organizations and individuals providing real estate brokerage services, and individuals practicing brokerage in the province (including individuals who do not meet the prescribed conditions).

The inspection contents include: Compliance with the Law on Real Estate Business 2023 and Decree No. 96/2024 of the Government on conditions for organizations and individuals when doing real estate business; operation and management of real estate trading floors; real estate brokerage activities; disclosure of information on real estate and projects.

Including key contents such as: Regarding the operating conditions of the floor (Business registration certificate, suitable industry; stable operating address, facilities and technical infrastructure meeting requirements; floor managers and operators having sufficient capacity to be responsible before the law); regarding the organization of the floor's operations (storing, providing transaction information and periodic reporting to the management agency; periodic reporting on the floor's operating situation). Regarding real estate brokerage activities, the conditions for practicing the profession and brokerage certificates will be checked. Regarding project information disclosure, the disclosure of legal information of real estate projects will be checked.

The inspection will assess the compliance with legal regulations on real estate business and brokerage activities according to the law; at the same time, detect, correct and promptly handle violations in management, operation and service provision of real estate brokerage floors and individuals; propose solutions to improve the management mechanism, enhance transparency and efficiency of the province's real estate market.
