The above content was presented by Mr. Nguyen Dac Vinh, Chairman of the Committee on Culture and Society, in the Report on explanation, acceptance and revision of the Law on Teachers at the 9th Session of the 15th National Assembly this morning (May 6).
Mr. Vinh said that this draft law stipulates more clearly the rights and obligations of teachers and what they are not allowed to do. The contents on the rights and responsibilities of teachers and workers stipulated in other laws will not be stipulated in the Law on Teachers.
Notably, the draft Law supplements regulations that teachers are allowed to participate in the management and operation of enterprises established by highereducation institutions, operating in the fields of scientific development, application and technology transfer.
"This content is consistent with Resolution No. 193/2025 of the National Assembly on piloting a number of special mechanisms and policies to create breakthroughs in science , technology, innovation and national digital transformation development," Mr. Vinh affirmed.
Do not disclose information about teacher violations
Regarding the regulation that organizations and individuals are not allowed to spread or disseminate inaccurate information or violations by teachers, the National Assembly Standing Committee believes that this regulation is necessary to protect the reputation and image of teachers from abuse, speculation and dissemination of information that has not been verified and does not have official opinions or conclusions from competent authorities.
For cases that have not been inspected or examined, information can still be reported if signs of violations or negative manifestations are detected. For cases that are being inspected or examined without a conclusion from the inspection or examination agency, information disclosure is not allowed, as it may affect the objectivity of the inspection or examination process.
"This regulation does not contradict the right to access information, rights, obligations and prohibited acts in the Press Law, the Law on Network Information Security, the Civil Code... Therefore, please keep the regulation as in the draft Law," Mr. Vinh emphasized.
The Chairman of the Committee on Culture and Society also stated that this bill stipulates that teachers' salaries are ranked highest in the administrative career salary scale system and have additional allowances depending on the nature of the job and the region.
The bill does not stipulate an increase of one starting salary level for teachers recruited and paid for the first time. Instead, the Government will provide detailed regulations.
The bill supplements a policy to support housing rent (equal to the rent for public housing) in cases where the place where teachers work cannot arrange public housing or collective housing.
Education sector recruits teachers
Regarding the recruitment and use of teachers, Mr. Nguyen Dac Vinh said that many opinions agree with the regulation on assigning the authority to recruit teachers to the education sector; there are opinions suggesting strong decentralization of recruitment authority.
The National Assembly Standing Committee found that delegating recruitment authority to the education sector is necessary, creating conditions for the sector to be proactive in recruiting, using, managing, and developing teachers, meeting requirements on quantity, structure, and quality; contributing to overcoming the situation of local surplus, shortage, and imbalance in the structure of teachers.
In response to the opinions of National Assembly deputies, the draft Law was adjusted to regulate the recruitment of teachers according to the level of education and training as in the draft Law. For schools of the People's Armed Forces, the recruitment of teachers is regulated by the Minister of Public Security and National Defense.
For other educational institutions, the recruitment of teachers is decided by the competent authority managing the educational institution. At the same time, the Government is assigned to specify in detail the contents related to the recruitment of teachers in public educational institutions and foreign teachers.
Regarding the policy of teacher mobilization, the National Assembly Standing Committee found that the mobilization of teachers from public educational institutions is a new and necessary policy, creating conditions for the education sector to overcome local surplus and shortage, ensuring the quality of education for regions and areas.
The Draft Law clearly stipulates the subjects, principles of mobilization, authority of mobilization, cases in which teachers cannot be mobilized; adds cases of mobilization to work in ethnic minority areas, mountainous areas, border areas, and islands to resolve policies for these subjects. The National Assembly will assign the Government to specify in detail the order and procedures for mobilizing teachers.
Teachers get early retirement
Regarding the proposal for preschool teachers to retire early, the National Assembly Standing Committee said that preschool teachers are not considered to work in arduous, toxic, or dangerous industries and professions.
However, preschool teachers have to perform specific tasks, with great pressure on work and working hours; when they are old, it will be difficult to complete their tasks. Many opinions of National Assembly deputies and relevant agencies agree to reduce the retirement age for preschool teachers with the regimes as stipulated in the draft Law.
In response to the proposal to specify requirements and conditions for teachers to extend their retirement age, the National Assembly Standing Committee believes that it is necessary and reasonable to stipulate that teachers with high qualifications, academic titles and degrees, teachers working in specific specialized fields and sectors can have their working time extended and retire at a higher age. This is to take advantage of and exploit high-quality human resources; to overcome the shortage of highly qualified teachers in a number of specific specialized fields and sectors that the country's development trend requires.
The draft law clearly stipulates the conditions for implementing this policy when educational institutions have a need, teachers are healthy enough and voluntarily extend their working time; at the same time, it adds criteria to meet the standards and conditions of educational institutions. During the period of extended retirement age, teachers in public educational institutions shall not hold leadership or management positions and shall not be allowed to retain leadership or management position allowances.
