According to lawyer Lien, individuals have the right to their own image. Anyone who uses another person's image must have that person's consent, except in cases where the law allows the use of another person's image for national, ethnic, or public interests without that person's consent, as specifically provided for in Clause 2, Article 32 of the 2015 Civil Code. In the case of using an individual's image for commercial purposes, there is an obligation to pay remuneration to the person whose image is used according to the provisions of law.
“In addition, the act of impersonating an individual's website is prohibited under Clause 3, Article 12 of the 2006 Law on Information Technology,” said lawyer Lien.
Lawyer Lien added that when discovering that someone else is using your personal image to impersonate a social network account for any illegal purpose, you can take measures to protect yourself, such as: quickly notify and correct information about the violation on your social network account to prevent and minimize possible damage; contact a bailiff to draw up a record of the ongoing violation in order to collect documents and evidence to protect your legitimate rights; request competent state agencies to resolve it with legal sanctions depending on the nature and severity of the violation.
