The State Bank is seeking comments on the Draft Amendment to Decree 24/2012 of the Government on the management of gold trading activities. One of the notable new points is that the drafting agency has added regulations related to payment when buying and selling gold. Specifically, the draft clearly states that when buying and selling gold worth 20 million VND or more, it must be done through the customer's payment account and the payment account of the gold trading enterprise opened at a commercial bank or a branch of a foreign bank. With the current price of over 120 million VND/tael, buyers of 2 taels of gold are required to pay by bank transfer.

According to the State Bank, this regulation aims to ensure the requirement of authenticating customer information but does not create additional obligations, because authentication has been performed when opening and using a bank account. In addition, payment via account helps to increase transparency and publicity in gold trading activities.
In fact, for nearly a year now, when people want to register to buy gold bars at 4 state-owned commercial banks, they are required to make bank transfer transactions. Previously, the General Department of Taxation had proposed that the State Bank study solutions to require non-cash payments in gold trading transactions, and at the same time establish a mechanism to control related transactions to avoid tax losses.
In addition, the Draft Amendment to Decree 24 also stipulates that the purchase and sale of raw gold between banks and enterprises must use electronic invoices, store and connect transaction data with competent authorities. At the same time, enterprises must clearly stipulate the process of buying and selling gold bars with customers; publicly announce information about the rights and obligations of customers on the electronic information page of the credit institution, enterprise or publicly post at the transaction office.
Enterprises and credit institutions that trade in gold bars must build an information system to ensure complete and accurate storage of gold bar trading data; connect and provide information to competent authorities according to the provisions of law.../.
