Regarding the verification of Nestlé Milo product advertisement (of Nestlé Vietnam Co., Ltd., located in Bien Hoa 1 Industrial Park, Dong Nai), on May 31, the Dong Nai Provincial Department of Health sent a report to the Dong Nai Provincial People's Committee on the progress of inspection, verification, and clarification.

Accordingly, the Dong Nai Provincial Department of Health said that the Technical Center for Standards, Measurement and Quality 3 has returned test results for samples of Nestlé Milo barley milk supplement food.
Test results show that the product has safety and quality indicators consistent with the enterprise's self-declared product profile.
According to the report, the Dong Nai Provincial Department of Health said the case is quite complicated, involving many sectors and subject to the regulation of many specialized laws such as: Law on Food Safety; Law on Product and Goods Quality; Law on Advertising; Law on Technical Standards and Regulations; Law on Protection of Consumer Rights.
Therefore, immediately after receiving the information, the Department of Health coordinated to establish an interdisciplinary inspection team including Department PC03 - Provincial Police, Department of Justice, Department of Science and Technology, Department of Culture, Sports and Tourism, and Market Management Department of Dong Nai province to conduct inspection, verification, and clarification of signs of violations by the enterprise.
By May 29, the Dong Nai Provincial Department of Health had transferred the case file and handed over all related documents to the Dong Nai Provincial Police Investigation Agency to verify and handle the case according to the provisions of law.
This is the next move after the inspection team and the Department of Health agreed to assess: Nestlé Vietnam Company Limited has shown signs of "deceiving or confusing consumers by providing false, incomplete, and inaccurate information about one of the contents specified in Point a, Clause 1, Article 10 of the Law on Protection of Consumer Rights".
Previously, Thanh Nien reported that the Food Safety Department received a complaint about Nestlé Milo products having advertising content related to clinical trial reports of the National Institute of Nutrition.
Decree 15/2018/ND-CP on food advertising stipulates: Advertising content must be consistent with the uses and effects of the product as announced in the product declaration; Do not use images, equipment, costumes, names, correspondence of medical units, facilities, doctors, pharmacists, medical staff, thank you letters from patients, articles of doctors, pharmacists, medical staff to advertise food.
Therefore, the Food Safety Department has sent a document to the Dong Nai Department of Health requesting to check, verify information, and handle Nestlé Milo product advertising according to current regulations.
