The 11th National Congress of the Party identified the seventh of the eight main characteristics of the socialist society that we are building as "building a socialist rule-of-law state of the people, by the people, for the people". Therefore, in order to advance to socialism, along with carrying out the tasks of developing a socialist-oriented market economy ; promoting industrialization and modernization; building an advanced culture imbued with national identity; building socialist democracy, realizing great national unity; building a clean and strong Party; firmly ensuring national defense and security; proactively and actively integrating internationally, the 11th National Congress of the Party has clearly pointed out the requirement to continue building a socialist rule-of-law state of the people, by the people, for the people in our country today.
The Socialist Republic of Vietnam is a rule-of-law state led by the Communist Party of Vietnam; a state of the people, by the people, for the people; human rights and civil rights are recognized, respected, guaranteed and protected according to the Constitution and laws; the State is organized and operates according to the Constitution and laws, and manages society by
the Constitution and laws; state power is unified, with clear division of labor, close coordination and effective control among state agencies in the exercise of legislative, executive and judicial powers; the legal system is democratic, fair, humane, complete, synchronous, unified, timely, feasible, public, transparent, stable, accessible, strictly and consistently implemented; the independence of the courts according to their jurisdiction, judges and juries are independent and only subject to the law; respect and ensure the implementation of international treaties to which the Socialist Republic of Vietnam is a member, ensuring the highest national interests on the basis of the fundamental principles of the United Nations Charter and international law. Human rights have become a global universal issue that any country or nation must respect and implement. These are the most noble values crystallized from the culture of human rights - the result of the struggle of mankind over thousands of years of history. Along with human rights, citizens' obligations are also implemented in accordance with legal regulations such as the obligation to respect the rights of others and everyone has the obligation to respect the rights of others, the obligation to prevent and treat diseases, the obligation to implement regulations on disease prevention, medical examination and treatment, the obligation to study, the obligation to protect the environment, accordingly everyone has the obligation to protect the environment. The issue of human rights and the construction and improvement of the legal system to ensure human rights have been mentioned very early in the documents of the Party and State of Vietnam. The 1945 Declaration of Independence also affirmed human rights when it stated: “All men are created equal. Their Creator has endowed them with certain inviolable rights; among these are the right to life, the right to liberty, and the right to pursue happiness. According to the provisions of the Constitution, organizations and individuals who pollute the environment, deplete natural resources, and reduce biodiversity must be strictly punished and responsible for remedying and compensating for damages. In particular, the duty of loyalty to the Fatherland, in which citizens have the duty of loyalty to the Fatherland, betrayal of the Fatherland is the most serious crime, along with the duty of protecting the Fatherland, in which protecting the Fatherland is the sacred duty and noble right of citizens. In which citizens must perform
military service and participate in building a national defense. Along with the duty of obeying the Constitution and laws of Vietnam, in which citizens have the duty of obeying the Constitution and laws; participating in protecting national security, order, social security and compliance with public rules. Photo Collection[/caption]For foreigners residing in Vietnam, they must comply with the Constitution and laws of Vietnam, have their lives, property, and legitimate rights and interests protected under Vietnamese law, and have the obligation to pay taxes, according to which everyone has the obligation to pay taxes according to the law. Thus, according to the above content, human rights can only be restricted according to the provisions of the law in necessary cases for reasons of national defense, national security, social order and safety, social morality, and public health. In general, all state power belongs to the people, promoting the people's mastery in the socialist rule of law state of Vietnam; state power is unified, with clear division of labor, close coordination, and effective control among state agencies in the exercise of legislative, executive, and judicial powers and the supervision of the people, under the leadership of the Party.
