Places where smoking is completely prohibited indoors and on premises

+ Facilities for care, nurturing, entertainment and recreation exclusively for children;

+ Facilities or areas with high risk of fire and explosion as prescribed in Appendix II of the List of facilities with risk of fire and explosion issued together with Decree No. 136/2020/ND-CP dated November 24, 2020 of the Government detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending and supplementing a number of articles of the Law on Fire Prevention and Fighting.

Places where smoking is completely banned indoors

+ Indoor workplaces of state administrative agencies, public service units, enterprises, political organizations, socio-political organizations, social organizations, socio-professional organizations and workplaces of other agencies, organizations and units.

+ Indoor areas of public places: food service establishments, entertainment service establishments, train stations, wharves, bus stations, religious and belief establishments, conference centers, shopping centers, markets, theaters, cultural houses, cinemas, circuses, clubs, sports halls, stadiums, community activity houses and common living areas of apartment buildings and other public places.

Public transport that completely bans smoking includes : Cars; Airplanes; Trains.

Places where indoor smoking is prohibited but designated areas for smokers are allowed: Airport isolation areas; Bars, karaoke bars, dance clubs; Hotels, motels, guesthouses, resorts and other tourist accommodation establishments; Public transport such as ships and trains.

Fines for violations of regulations on smoking-free areas

Warning or fine from 200,000 VND to 500,000 VND for smoking in prohibited areas. Smoking on aircraft shall be subject to the provisions on administrative sanctions for violations in the field of civil aviation.

A fine of VND 3,000,000 to VND 5,000,000 shall be imposed for one of the following acts: Not having the words or symbol "no smoking" at a place where smoking is prohibited as prescribed by law; Not organizing, guiding, inspecting, and urging the correct implementation of regulations on smoking prohibition at a place under management and operation.

Fines from VND 5,000,000 to VND 10,000,000 for one of the following acts in a place designated for smokers: No room and ventilation system separate from the non-smoking area; No cigarette butt and ash containers; No signs in suitable, easy-to-observe locations; No fire prevention and fighting equipment.

In addition, other violations of regulations on tobacco harm prevention and control are punished as follows:

Warning or fine from 200,000 VND to 500,000 VND for people from 16 years old but under 18 years old who use tobacco.-

Fine from 500,000 VND to 1,000,000 VND for one of the following acts: Encouraging or forcing others to use tobacco; Using people under 18 years of age to buy tobacco.

Fines from VND 3,000,000 to VND 5,000,000 shall be imposed for one of the following acts: Using images of tobacco in newspapers and publications specifically for children; Providing unscientific and inaccurate information about tobacco and its harmful effects; Not including tobacco harm prevention and control in annual work plans, not including regulations prohibiting smoking in the workplace in internal regulations; Not restricting images of actors using tobacco in theatrical and cinematic works according to the provisions of law.

Fines from VND 20,000,000 to VND 30,000,000 shall be imposed for one of the following acts: Using the name, trademark and logo of tobacco products with other products and services; Marketing tobacco directly to consumers in any form; Allowing organizations and individuals to market tobacco directly to consumers at establishments under their management and operation; Late payment of mandatory contributions as prescribed by law; False declaration leading to insufficient payment of mandatory contributions as prescribed by law; Using support funds from the Tobacco Harm Prevention Fund not in accordance with the law; Enterprises and mass media reporting and announcing sponsorship from tobacco business organizations and individuals.

A fine of VND 30,000,000 to VND 40,000,000 shall be imposed for one of the following acts: Carrying out sponsorship activities in any form, except in cases permitted by law; Evading or defrauding mandatory contributions as prescribed by law.
