'Astronomical' brokerage fees, profiteering from labor export: Tighten discipline, strictly handle violations

In recent times, the Government E-newspaper and the Government E-information Portal have continuously received feedback from readers and workers about the situation of labor export brokerage companies charging excessive fees, showing signs of tax evasion, illegal collection of money, and even fraud.

Reader D.TN with email address [email protected] reflects: "Poor workers, with the legitimate desire to escape poverty, have accepted to leave their hometowns and families to find work opportunities. But instead of being supported, they are suffocated by brokers with excessively high fees, from 5,000 to 8,000 USD.

Many brokerage companies force workers to sign papers and record videos admitting they paid $2,000 to $4,000 to avoid authorities and evade taxes. Workers do not dare to speak out for fear of retaliation or being denied exit. Nearly half of the time they work is spent paying off brokerage fees, leading to an unstable life and a heavy pressure on their families back home."

Sending a letter to the Government Portal, reader KC reported that two individuals in Bac Ninh illegally collected cash from workers (working as welders) in the amount of 18-20 thousand USD but so far have only returned about 52 million and hoped that the authorities would have a management solution to ensure the rights of workers.

Speaking with the Government E-newspaper, a representative of the Department of Overseas Labor Management (Ministry of Home Affairs) - the state management agency in the field of Vietnamese workers working abroad under contracts, said that recently, the Department has consulted competent agencies to promulgate and perfect the legal system to regulate the activities of sending workers to work abroad under contracts.

The provisions of the Law on Vietnamese Workers Working Abroad under Contract, along with the guiding decrees and circulars, clearly state the rights and obligations of workers working abroad under contract, as well as the rights and obligations of businesses licensed to send workers to work abroad.

In particular, the law clearly stipulates the expenses that service businesses are allowed to collect from employees, avoiding illegal collection, creating a cost burden for employees.

In addition to perfecting the system, the Department of Overseas Labor Management also strengthens propaganda and dissemination of laws so that workers can clearly understand and grasp regulations and update information to protect their own rights.

At the same time, the Department publicizes the list of businesses licensed to provide services of sending workers to work abroad on its website, to help workers access the right competent units, avoiding being exploited by organizations and individuals who do not meet legal requirements.

Many cases are being investigated and processed.

Despite many efforts from state management agencies, reality shows that the situation of organizations and individuals taking advantage of the need to work abroad for personal gain continues to be complicated.

A representative of the Department of Overseas Labor Management said that they have received many complaints from workers about being charged money and promised to work abroad by organizations and individuals without operating licenses. There are even organizations and individuals impersonating competent authorities or licensed businesses to defraud and take advantage of workers.

In response to these incidents, the Department has proactively posted many warnings on the Department's Electronic Information Portal to raise workers' vigilance. For specific incidents, the Department also forwards complaints to competent authorities such as the Police and the Department of Home Affairs of provinces and cities for inspection, verification and handling in accordance with the law.

In some cases, the Department has coordinated with the Police and the Hanoi Department of Home Affairs to organize an interdisciplinary inspection team to inspect and verify organizations and individuals that do not have the function but organize the selection and collection of money from workers.

A representative of the Department of Overseas Labor Management said that in the coming time, the Department of Overseas Labor Management will strengthen coordination with local police agencies and Departments of Home Affairs to inspect organizations and individuals that do not have a license to operate services to send workers to work abroad under contracts but have announced recruitment, registered, received applications, and collected money from workers to send them to work abroad.

Companies that violate the law will be dealt with by the authorities according to the law. In fact, many companies have been investigated for signs of violations in sending workers to work abroad.

Recently, the Ministry of Public Security is investigating and verifying signs of violations related to the field of workers going to work abroad at Hoang Long Construction Investment and Human Resources Supply Joint Stock Company, Construction and Installation International Cooperation One Member Co., Ltd. 3, International Human Resources Supply and Trade One Member Co., Ltd. (SONA)...

Regarding the KC workers' reflection that two individuals in Bac Ninh illegally collected cash from workers (working as welders) in the amount of 18-20 thousand USD but have so far only returned about 52 million, the Department of Overseas Labor Management affirmed that, according to the provisions of the Law on Vietnamese Workers Working Abroad under Contract, there is no individual licensed by the Ministry of Labor, Invalids and Social Affairs (now the Ministry of Home Affairs) to operate the service of sending Vietnamese workers to work abroad under contract.

Based on the content of the petition, the above case shows signs of violating the law. Therefore, on June 2, the Department of Overseas Labor Management issued Official Dispatch No. 563/CQLLDNN-KTGQKNTC to the Bac Ninh Provincial Police for inspection, verification and handling in accordance with the provisions of law.

The representative of the Department of Overseas Labor Management also advised workers to be extremely alert when choosing a labor export company. They should only work with legally licensed businesses, check public information on the Department's Electronic Information Portal, and not trust verbal promises or cash transactions with unclear individuals or intermediary organizations.

Working abroad is an important opportunity for workers to increase their income, gain experience, and contribute to the economic development of their families and society. However, without proper protection and sufficient legal information, workers can easily become victims of illegal profiteering.

Therefore, along with strengthening management from state agencies, workers themselves need to proactively learn the law and be careful in every decision to protect their legitimate rights.
