BTO-On the morning of May 21, the 15th National Assembly, 7th session discussed and commented on the draft Road Law. Mr. Nguyen Huu Thong - Deputy Head of the National Assembly Delegation of Binh Thuan province commented on the content of the draft law.
The Draft Law stipulates many contents that need to be clearly explained to facilitate implementation, as well as facilitate research, teaching, and dissemination of the law, and to serve as a basis for applying and resolving related cases later. Therefore, the Deputy Head of the National Assembly Delegation proposed to add to Article 2 an explanation of terms such as: Road classification (Articles 8 and 9), road safety corridor (Article 15), road load and size limits (Article 27), intelligent transportation (Article 40), traffic accounts (Article 43), highways (Article 44), road transport activities (Article 56), multimodal transport (Article 67), etc.
Regarding road transport activities (Article 56), it is proposed to add the business type of passenger transport by electric four-wheeled vehicles operating in restricted areas to Clause 6, Article 56. Because the Government is currently allowing 35 provinces and cities to pilot operations within restricted areas; on April 9, 2024, the Ministry of Transport issued Document No. 3795/BGTVT-VT on the pilot operation of electric four-wheeled vehicles carrying tourists in restricted areas to the Prime Minister and proposed to include it in the Road Law. In my opinion, this proposal of the Ministry of Transport is appropriate.
According to Mr. Thong, it is necessary to remove the paragraph: "attaching, hanging, installing on road signs contents unrelated to the meaning and purpose of road signs." In Clause 4, Article 7, because in Clause 8, Article 23 of the draft Law, it is stipulated that the installation of road signs must ensure technical and legal regulations, including the installation of traffic signs and contents related to the meaning and purpose of road signs (sub-signs). The above regulation may create a misunderstanding that it is possible to attach, hang, or install on road signs contents related to the meaning and purpose of road signs but not the directional signs, sub-signs as stipulated in Article 23. It is proposed to remove Clause 5, Article 18 of the draft, because the construction, installation of works, and licensing of construction of advertising works have been stipulated in the Law on Advertising, so it is proposed to remove Clause 5 to avoid overlapping conflicts. Clause 1, Article 45 stipulates: "Expressways are designed according to specific technical standards and regulations."
The design and construction of highways are applied according to a number of technical standards and criteria, giving rise to a number of problems that do not meet the requirements for safe traffic on highways. To overcome this situation, it is proposed to consider amending Clause 1, Article 45 to: "Highways are designed according to highway technical standards and regulations" .
