Ms. Nguyen Thanh Hai assessed that in recent times, management work related to chemicals has been lax, with the situation of chemicals being released into the environment, chemicals being sold in food being rampant... The reason is partly due to the lack of strict management and poor division of management in this field.
Therefore, the Chairman of the Delegation Work Committee suggested that the provisions of the draft revised Law this time should be more clearly expressed on the issue of assigning management focal points, clearly identifying the agency responsible for presiding over and the agency responsible for coordination.
" For example, the situation of bean sprouts being soaked in chemicals may be due to market management, awareness of producers... but why do bean sprout producers buy chemicals so easily?
Or in the past, cyanide poisoning cases, why was it so easy to buy, people could even find out and buy online. When this problem happened, is the Ministry of Industry and Trade, the Ministry of Health or the Ministry of Agriculture and Environment responsible? ", Ms. Nguyen Thanh Hai said.
Ms. Nguyen Thanh Hai quoted the opinion of National Assembly Chairman Tran Thanh Man when discussing the reception, explanation, and revision of the draft Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations, which is to clarify the responsibilities of the National Assembly, the Government, and relevant ministries and branches in order to handle the matter.
Citing the fact that foods used daily can be soaked in chemicals, Ms. Nguyen Thanh Hai suggested that the Law on Chemicals (amended) must convey a strong message that if chemical incidents such as discharge into the environment related to food occur, there must be an agency responsible.
" I have tested it, there are apples bought at expensive stores, they don't need to be kept in the refrigerator and they don't spoil for months. If it is clean fruit, it will rot after 1-2 days and flies will come. Now, when soaked in chemicals, flies don't even want to come. Where is the responsibility? ", the Chairman of the Delegation Work Committee stated the reality.
Emphasizing once again the need for regulations on responsibility when incidents involving chemicals occur, Ms. Nguyen Thanh Hai said that when assigning responsibility, it is also necessary to assign authority to those ministries and branches to request other agencies to coordinate in implementation.
Another issue raised by Ms. Nguyen Thanh Hai is that the Law on Chemicals (amended) is related to the Law on Technical Standards and Regulations, the Law on Environmental Protection, and the Law on Food Safety. Therefore, she requested that the drafting agency and the reviewing agency confirm to the National Assembly deputies that the regulations have been reviewed, ensuring strictness, without overlap or duplication.
" It is necessary to ensure that when an incident occurs, there will be overall connectivity between laws, ensuring that there are no gaps or legal loopholes ," said the Chairman of the Delegation Work Committee.
Speaking at the meeting, National Assembly Chairman Tran Thanh Man said that the draft Law needs to focus on strengthening safety management and environmental protection.
"When talking about chemicals, many people will immediately think of toxic substances, additives, and places where chemicals are produced. Farmers who grow rice, fruit trees, vegetables, etc. also use chemicals. Therefore, stricter regulations are needed on the purchase, transportation, and import of chemicals of unknown origin.
It is necessary to add criteria for toxic chemicals, measures to prevent and respond to chemical incidents. This is extremely important for State management. Typically, in the area, the specialized ministry will manage or will assign management to the locality, it also needs to be clearly regulated, " said the National Assembly Chairman.
The National Assembly Chairman proposed to update Resolution 57 and Resolution 68 of the Politburo into the Law. In particular, administrative procedures are currently an extremely important and key issue for business development. Any procedures of ministries, branches, provinces, communes and wards... need to be clear and specific.
The National Assembly Chairman also proposed strengthening regulations on prohibited acts; adding prohibited acts related to chemicals of unknown origin, exceeding the permitted threshold, and smuggling. In particular, smuggling will be carried out by many routes such as air, road, sea, etc., so there must be regulations for coordination between functional agencies.
" Because of the shortcomings, this time the Chemical Law must be revised. When revising, any shortcomings must be calculated to be revised to increase the longevity of the law. Do not let the law be promulgated and then found to be lacking in this or that place ," the National Assembly Chairman noted.
Previously, presenting a report on the reception, explanation and revision of the draft Law on Chemicals (amended), Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy said that recently, the misuse of some chemicals has caused serious consequences for human health, social order and safety, causing outrage among voters and the people.
Especially activities such as buying, selling, and using cyanide compounds for the wrong purposes and using nitrous oxide (N2O - laughing gas) for entertainment purposes... Therefore, to strengthen the management of toxic chemicals and control risks of unsafety and security from chemicals, the draft Law has amended and supplemented a number of regulations compared to the 2007 Law on Chemicals.
Specifically, amend and supplement regulations on chemical management throughout the entire life cycle, from the time the chemical is created or brought into Vietnam with a strict level to ensure consistency with each chemical list. Supplement regulations on inspection measures for the import of chemicals requiring special control and chemical storage services requiring special control.
Supplementing regulations on the application of digital technology and digital transformation in controlling the purchase and sale of chemicals requiring special control, data on purchase and sale activities will be authenticated with data on organizations and individuals purchasing and selling according to the implementation roadmap prescribed by the Government.
Supplementing regulations requiring organizations and individuals using chemicals requiring special control to register the purpose and need for using chemicals on the database, especially post-inspection work to minimize the misuse of chemicals.
In addition, the draft Law supplements regulations that chemical trading organizations are only allowed to sell chemicals requiring special control to organizations and individuals that have declared the type of chemical and its intended use on the Chemical Specialized Database.
In the spirit of innovation in law-making, the draft Law does not specifically stipulate the division of State management among Ministries and localities, but this is regulated by the Government based on the provisions of the Law on Organization of the Government.
" However, currently, a chemical can be used in many different fields, managed by many ministries; this can easily lead to businesses dishonestly declaring the purpose of use in order to choose a more open mechanism ," Mr. Le Quang Huy stated the reality.
