With 470/470 National Assembly delegates present voting in favor, on the morning of June 16, the 9th Session of the National Assembly passed the Resolution amending and supplementing a number of articles of the Constitution of the Socialist Republic of Vietnam.

Only amend and supplement 05/120 articles and clauses

Before voting to pass, the National Assembly listened to Vice Chairman of the National Assembly Nguyen Khac Dinh explain, accept and revise the draft Resolution amending and supplementing a number of articles of the Constitution of the Socialist Republic of Vietnam to submit to the National Assembly for approval.

Vice Chairman of the National Assembly Nguyen Khac Dinh said that on May 6, 2025, in accordance with the plan of the Committee for Drafting Amendments and Supplements to a Number of Articles of the Constitution, the draft Resolution was widely announced to solicit opinions from the People, sectors and levels. This activity has been urgently, synchronously, democratically and widely implemented by agencies and organizations from the central to all localities with many diverse and creative forms, strongly applying information technology, thus attracting the active and enthusiastic participation of the majority of people.

With 280,226,909 comments on all contents of the draft Resolution, it has shown the interest, support and high sense of responsibility of all classes of people towards the important work of the country. The collection of public opinions on amending and supplementing the Constitution has truly become a widespread, democratic political and legal activity in the entire political system and the whole society.

The comments and suggestions of the People, central and local agencies and organizations, experts and scientists have been fully, honestly and objectively synthesized by the Government in Report No. 472/BC-CP and many attached appendices.

On that basis, the Committee for Drafting Amendments and Supplements to a Number of Articles of the Constitution has organized many meetings and many times taken votes and asked for written opinions to organize research, explanation, reception, revision and completion of the draft Resolution to be submitted to the National Assembly for consideration and approval according to the principle: All comments, whether majority or minority, are researched and considered fully, objectively and thoroughly, and not considered because they are minority opinions.

For major and important issues that arise during the process of collecting public opinions or during the process of receiving and revising, the Committee promptly reports and asks for instructions from competent authorities. The Politburo and the Secretariat meet weekly to hear reports on the situation and results of collecting public opinions, and to give instructions on receiving opinions and revising the draft Resolution amending and supplementing a number of articles of the Constitution.

After each time of receiving and revising, the content of the draft Resolution has been increasingly improved. Initially, the Committee proposed to amend and supplement 08/120 articles and clauses of the 2013 Constitution, but after studying the very accurate, reasonable, logical, and convincing comments from agencies, organizations, the People, experts, scientists, and National Assembly deputies, the Committee proposed to accept and only amend and supplement 05/120 articles and clauses, retaining 03 articles to continue implementing according to the provisions of the current Constitution.

The contents that remain the same as now are the regulations on consulting the People when establishing, dissolving, merging, dividing, and adjusting the boundaries of administrative units (Clause 3, Article 110); regulations on "local government" and "local government levels" (Articles 111, 112, and 114); on the right to question of People's Council delegates (Clause 2, Article 115). At the same time, the Committee also accepted and revised all 5/5 articles and clauses proposed for amendment and supplementation in the Constitution and the implementation provisions and transitional provisions in the draft Resolution, ensuring consistency and unity in both content and technical expression.

The contents that the People and National Assembly deputies have commented on but have not been accepted have been studied, considered, specifically explained and fully reported to the National Assembly in Reports No. 15 and No. 17-BC/UBDTSĐBSHP of the Committee for Drafting Amendments and Supplements to a Number of Articles of the Constitution.

The beginning of profound institutional reform

Compared with the draft Resolution submitted to the National Assembly for discussion at the meeting on June 13, 2025, the draft Resolution submitted to the National Assembly for approval has received comments from National Assembly deputies, revised and supplemented the provisions at the end of Clause 3, Article 2 of the draft Resolution to create a basis for smooth transition in the process of arranging and perfecting the organization of the local government apparatus in administrative units nationwide when switching to a two-level local government model, especially in wards in Hanoi, Ho Chi Minh City and Da Nang that are implementing the urban government model without organizing a People's Council.

After being absorbed and revised, the draft Resolution submitted to the National Assembly for approval has 02 articles, of which Article 1 amends and supplements 05 articles and clauses of the current Constitution (including Article 9, Article 10, Clause 1 of Article 84, Article 110 and Article 111); Article 2 stipulates the effective date of the Resolution, the end of the operation of district-level administrative units and transitional provisions (reviewed, absorbed and revised to specify Conclusions No. 150-KL/TW, No. 163-KL/TW and No. 167-KL/TW of the Politburo and the Secretariat).

After the Resolution amending and supplementing a number of articles of the Constitution of the Socialist Republic of Vietnam and the Law on Organization of Local Government (amended) was passed by the National Assembly, the Standing Committee of the National Assembly issued 34 resolutions on the arrangement of commune-level administrative units together with Resolution No. 202/2025/QH15 of the National Assembly on the arrangement of provincial-level administrative units, which will create a complete and synchronous legal basis, ensuring that all administrative units across the country uniformly implement the 2-level local government model and administrative units formed after the arrangement will officially operate from July 1, 2025.
