National Assembly passes Data Law, regulating cross-border data processing

(Dan Tri Newspaper) - The Data Law, recently passed by the National Assembly , stipulates the transfer and processing of data across borders, and cases where data must be provided to state agencies.

On the afternoon of November 30th, with 451 out of 458 attending delegates voting in favor, the National Assembly passed the Data Law. The law will take effect on July 1st, 2025.

The recently passed law stipulates regulations on the transfer and processing of cross-border data. Accordingly, agencies, organizations, and individuals are free to transfer data from abroad to Vietnam, process foreign data in Vietnam, and are protected by the State in accordance with the law.

The transfer of core and critical data includes: Transferring data currently stored in Vietnam to a data storage system located outside of Vietnam.

Vietnamese agencies, organizations, and individuals transfer data to foreign organizations and individuals in Vietnam. Vietnamese agencies, organizations, and individuals use processing platforms located outside the territory of Vietnam to process data.

The transfer and processing of data as stipulated above must ensure national defense and security, protect national interests, public interests, and the legitimate rights and interests of data subjects and data owners as prescribed by Vietnamese law and international treaties to which Vietnam is a party. The law assigns the Government the authority to provide detailed regulations on this matter.

The law encourages domestic and foreign organizations and individuals to provide data they own to state agencies.

Organizations and individuals must provide data to state agencies upon request from competent authorities without the data subject's consent in the following cases: Responding to emergencies; When there is a threat to national defense and security but not to the extent of declaring a state of emergency; Disasters; Riot and terrorism prevention and control.

In addition, government agencies that receive the data are responsible for using it for the intended purpose.

This agency also ensures data security and safety, protects data confidentiality, and safeguards other legitimate interests of data subjects, organizations, and individuals providing data in accordance with the law...
