New regulations for Market Management force

Specifically, Decree No. 241/2025/ND-CP amends and supplements Article 2 on the subjects of application and Clause 1, Article 4 of Decree No. 33/2022/ND-CP on the positions with the authority to issue inspection decisions to comply with the new organizational structure of the Market Management force as prescribed in Decree No. 40/2025/ND-CP as follows:

" Article 2. Subjects of application

1. Market Management Agencies at all levels, including: Department of Domestic Market Management and Development under the Ministry of Industry and Trade ; Market Management Department under the Department of Domestic Market Management and Development; Market Management Sub-Departments under the Department of Industry and Trade of provinces and centrally run cities and Market Management Team under the Market Management Sub-Departments.

2. Civil servants working at Market Management agencies at all levels.

3. Other agencies, organizations and individuals related to the organization and operation of the Market Management force.".

Decree No. 241/2025/ND-CP amends and supplements Clause 1, Article 4 of Decree No. 33/2022/ND-CP, specifically:

"1. The person with the authority to issue the inspection decision prescribed in Clause 1, Article 21 of the Market Management Ordinance includes:

a) Director of the Department of Domestic Market Management and Development under the Ministry of Industry and Trade;

b) Head of Market Management Department under the Department of Domestic Market Management and Development; Head of Market Management Department under the Department of Industry and Trade of a province or centrally-run city (hereinafter referred to as Market Management Department);

c) Captain of the Market Management Team of the Market Management Department.".

Change the names of positions to match the new organizational structure of the Market Management force.

Decree No. 241/2025/ND-CP amends Clause 1, Article 5 of Decree No. 33/2022/ND-CP on working vehicles of the Market Management force in the direction of eliminating some types of vehicles: cars with prescribed titles, pickup trucks, other specialized cars serving specific tasks to comply with the provisions of Decree No. 72/2023/ND-CP on standards and norms for car use. At the same time, the phrase "specialized inspector" is removed to comply with the orientation that "agencies assigned to perform specialized inspection functions do not organize specialized inspections". Specifically as follows:

"1. Working vehicles serving the inspection and handling of administrative violations of the Market Management force include: Cars for general work; specialized vehicles: trucks, cars with more than 16 seats, cars equipped with laboratories; motorbikes; speedboats; walkie-talkies, measuring and quick inspection equipment, specialized equipment, information technology equipment, electronics, machinery, office equipment and other professional technical means and equipment according to work requirements and according to regulations of law.".

In addition, Decree No. 241/2025/ND-CP also amends Point d, Clause 2, Article 9 of Decree No. 33/2022/ND-CP on the ranks of positions in the Market Management force in the direction of amending the names of positions to match the new organizational structure of the Market Management force. Specifically:

"d) The star insignia represents the leadership position in gold-colored metal with embossed patterns. The star is mounted in a straight vertical row in the middle of the insignia background, located between the shield, pine branch and insignia buttons.

The rank insignia of the Director of the Department of Domestic Market Management and Development has 02 stars with a diameter of 26 mm.

The rank insignia of the Deputy Director of the Department of Domestic Market Management and Development is attached with 01 star, size 26 mm in diameter.

The rank badge of the Head of Department and equivalent of the Department of Domestic Market Management and Development; the Head of Sub-Department, Head of Department, and Captain of Market Management Team of the Market Management Sub-Department are attached with 02 stars of 22 mm diameter.

The rank insignia of Deputy Head of Department and equivalent of the Department of Domestic Market Management and Development; Deputy Head of Sub-Department, Deputy Head of Department, Deputy Head of Market Management Team of the Market Management Sub-Department are attached with 01 star with diameter size of 22 mm.

The rank insignia of civil servants who do not hold leadership positions do not have a rank star attached;

d) Rank badge: metal rank badge, attached to the square top of the rank badge background.

The rank insignia of Department-level leaders, equivalent positions of the Department of Domestic Market Management and Development and leaders of the Market Management Sub-Department have 02 yellow horizontal stripes.

The rank badge of the leaders of the Department level, Market Management Team under the Market Management Department has 01 horizontal yellow stripe.

The rank insignia of civil servants who do not hold leadership positions have a silver stripe, including: Senior market controller and equivalent have 3 horizontal stripes; Main market controller and equivalent have 2 horizontal stripes; Market controller and equivalent have 1 horizontal stripe; Intermediate market controller and equivalent have 1 horizontal "V" stripe.

Clearly define the authority in deciding to issue purchasing regimes

Decree No. 241/2025/ND-CP amends and supplements Clause 4, Article 11 of Decree No. 33/2022/ND-CP in the direction of clearly defining the authority of the Minister of Industry and Trade and the Provincial People's Council in deciding to promulgate the procurement regime and procedures for issuing badges, flags, ranks, signs and uniforms. Specifically:

"4. The Minister of Industry and Trade decides to promulgate the procurement regime, procedures for issuing badges, flags, insignia, signs and uniforms for civil servants working at the Department of Domestic Market Management and Development. The People's Councils of provinces and centrally run cities decide to promulgate the procurement regime, procedures for issuing badges, flags, insignia, signs and uniforms for civil servants working at the Market Management Sub-Department.".

At the same time, amend and supplement Clause 12, Article 13 of Decree No. 33/2022/ND-CP related to the authority of the Chairman of the Provincial People's Committee and the Minister of Industry and Trade on the conversion of uniform allocation. Specifically:

"12. Based on the specific weather conditions in each region, the Chairman of the People's Committee of the province or centrally-run city shall decide to convert the issuance of coats, trench coats, windbreakers, and cotton jackets to other uniforms for civil servants working at the Market Management Department, but not exceeding the uniform unit price approved by the competent authority.

The conversion of the issuance of coats, trench coats, windbreakers, and cotton jackets to other uniforms for civil servants working at the Department of Domestic Market Management and Development shall be decided by the Minister of Industry and Trade.".

This Decree takes effect from the date of signing and promulgation (September 10, 2025). The provisions in Clause 1, Article 5 of this Decree take effect from January 1, 2026.
