New regulations on granting licenses for cross-border tourist vehicle transportation

Contract vehicles, intermodal tourism between Vietnam - Laos not exceeding 30 days

Compared to Decree 119/2021, Decree 41/2024 supplements regulations on international road transport licenses and intermodal licenses for contract passenger transport vehicles and tourist passenger transport vehicles.

Decree 41/2024 stipulates that passenger transport vehicles under contract and tourist passenger transport vehicles are granted a license for intermodal transport between Vietnam and Laos according to the duration of the trip or the duration of the tour but not exceeding 30 days (illustrative photo).

Accordingly, the transit permit between Vietnam and Laos of this type is allowed for multiple trips and will be issued according to the duration of the trip or the time of the tour but not exceeding 30 days.

There are two types of intermodal transport permits issued to commercial vehicles between Vietnam and Cambodia: Type 1 is issued to vehicles that travel back and forth multiple times, each time not exceeding 30 days, with a maximum validity of 1 year; Type 2 is issued to vehicles that travel once with a validity of not exceeding 30 days.

In addition, the Decree also adds regulations on intermodal transport permits issued to non-commercial vehicles between Vietnam and Laos or Vietnam - Laos - Cambodia that are allowed to travel multiple times and are issued according to the duration of the trip but not exceeding 30 days.

Intermodal permits issued to official vehicles, vehicles of diplomatic agencies and international organizations between Vietnam and Laos are allowed to travel multiple times and are issued according to the duration of the trip but not exceeding 1 year.

Regarding the intermodal transport license issued to non-commercial vehicles between Vietnam and Cambodia (except for fire trucks and ambulances which are exempted from the license according to the provisions of the Vietnam - Cambodia Road Transport Agreement), there are also two types: Type 1 is issued to vehicles that travel back and forth multiple times, each time not exceeding 30 days, with a maximum validity of 1 year; Type 2 is issued to vehicles that travel once with a validity of not exceeding 30 days.

This amendment is to comply with the Protocol implementing the Agreement on facilitating road motor vehicles crossing the border between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic.

More cases of revocation of intermodal transport licenses

Decree 41/2024 adds cases of revocation of ASEAN intermodal transport licenses, GMS international road transport licenses or temporary vehicle import registration books (TAD), international road transport licenses between Vietnam and China, intermodal transport licenses between Vietnam and Laos, intermodal transport licenses between Vietnam and Cambodia when the vehicle's badges and signs are revoked or revoked by competent authorities. Accordingly, vehicles whose badges and signs are revoked or revoked are not allowed to conduct transportation business.

In addition, the Decree also adds a provision to return the issued license (except in case of loss) in case the ASEAN transit license, GMS transit license or TAD book, transit license between Vietnam and Laos, transit license between Vietnam and Cambodia, between Vietnam, Laos and Cambodia expires or is still valid but the page with the confirmation stamp of the management agencies at the border gate has expired or is damaged or lost to the licensing agency.

If the organization, individual, or transport business unit still needs to register for exploitation, prepare a request for re-issuance according to regulations.

The Ministry of Transport said that this paper must be returned to the licensing authority for inspection and license revocation for vehicles: Not performing ASEAN intermodal transport activities within 2 months from the date of issuance of the intermodal license; Not performing ASEAN intermodal transport activities for 3 or more trips within 6 consecutive months (trips are counted as both outbound and return trips); Or refusing to issue licenses for vehicles whose licenses are still valid but still request a new license.

Decree 41/2024 also decentralizes the authority to grant international road transport licenses between Vietnam and China, type D, for Chinese vehicles to the Departments of Transport of provinces with border gates implementing the Vietnam - China Road Transport Agreement (illustrative photo).

Decentralization of authority to grant intermodal transport licenses to localities

In the regulation on granting international road transport licenses between Vietnam and China, type D, for Chinese vehicles, the Decree stipulates decentralization to the Department of Transport of provinces with border gates implementing the Vietnam - China Road Transport Agreement to grant type D transport licenses to facilitate Chinese transport units in requesting the issuance of this transport license.

Accordingly, the Departments of Transport with the authority to issue type D transport licenses include: Lai Chau, Ha Giang, Cao Bang, Lang Son, Quang Ninh and the Department of Transport - Construction of Lao Cai, based on the transport route and pairs of border gates under their management, issue type D licenses to Chinese transport vehicles.

In addition, the issuance and re-issuance of international road transport licenses between Vietnam and Laos is also thoroughly decentralized to the Department of Transport, Department of Transport - Construction of provinces and cities. Currently, in addition to the Department of Transport, the Vietnam Road Administration is still the agency that issues these transport licenses.

In addition, the Decree also stipulates adding the Vehicle Registration Certificate to the dossier for granting a Type D transport license to check the information declared on the application for a D license and to record accurate information on the Type D transport license.
