Reporting on the explanation, reception and revision of the draft Law on Teachers, Chairman of the Committee on Culture and Society Nguyen Dac Vinh said: After reception and revision, the draft Law consists of 9 chapters and 42 articles, 4 articles less than the draft Law submitted to the National Assembly at the beginning of the 9th Session.
Regarding the rights of teachers (Article 8), Mr. Nguyen Dac Vinh said: There is a proposal to add teachers in vocationaleducation institutions to participate in the management and operation of enterprises.
The National Assembly Standing Committee recognizes that allowing university lecturers to participate in the management and operation of enterprises is a new policy that has been thoroughly discussed and has a high level of consensus. However, the expansion of this policy to teachers in vocational education institutions needs to be further studied, evaluated, and summarized in practice to have sufficient grounds for consideration and regulation at the appropriate time.
Regarding things that cannot be done (Article 11), there are suggestions to add regulations prohibiting teachers from giving extra lessons in violation of the law, prohibiting extra lessons for students that teachers are directly teaching; and clarifying that organizations and individuals are not allowed to post or disseminate information about teachers.
There are suggestions to add the concept of "extra teaching"; regulate the management of extra teaching and learning to improve the quality of teaching and learning in schools; assign the Government to develop a set of regulations on extra teaching and learning and prohibit teachers from giving extra teaching in violation of the law; propose to prohibit teachers from giving extra teaching to students they are directly teaching.
Regarding this content, the National Assembly Standing Committee said that the management of extra teaching and learning falls under the scope of the Law on Education and will be specifically regulated in the implementation guidance document. The draft Law on Teachers does not prohibit extra teaching and learning, but only stipulates that teachers are not allowed to force students to participate in extra learning in any form in order to limit and overcome the widespread situation of extra teaching and learning and profiteering from extra teaching and learning activities. Currently, the Ministry of Education and Training has issued a document regulating extra teaching and learning, which clearly states the prohibition of teachers from giving extra teaching to students they are directly teaching.
Regarding the policy on salary, allowances, support, and attraction of teachers (Articles 25, 26, 27), there are opinions suggesting clarifying the regulations on teachers' salaries being ranked highest in the administrative career salary scale system; ensuring fairness in salaries between teachers in the public sector and the non-public sector.
The Standing Committee of the National Assembly believes that teachers in public educational institutions are civil servants; therefore, teachers' salaries are implemented according to the administrative career salary scale commonly applied to civil servants.
The draft Law stipulates the principle that teachers' salaries are ranked highest in the administrative career salary scale in order to institutionalize the Party's policy in Conclusion No. 91-Kl/TW of the Politburo on continuing to implement Resolution No. 29-NQ/TW of the Central Executive Committee on fundamental and comprehensive innovation in education and training. The detailed regulations on salaries and allowances for teachers, including coefficients, starting salaries, salary ranking mechanisms for teachers in autonomous educational institutions... will be specified in detail by the Government in the implementation guidance document to ensure flexibility, feasibility, and correlation and fairness with civil servants in the political system.

Regarding the proposal to revise regulations on teachers' salaries to ensure fairness between teachers in the public and non-public sectors, the National Assembly Standing Committee said: The Draft Law submitted to the National Assembly at the 8th Session has provisions on salary policies applicable to non-public teachers, ensuring that the salary is not less than that of public teachers with the same training level and title.
However, many delegates said that this regulation is unreasonable, violates the principle of voluntariness and autonomy of non-public educational institutions, and could lead to an increase in tuition fees and other surcharges, affecting the policy of socializing education.
Incorporating the opinions of National Assembly deputies at the 8th Session, the draft Law was revised in the direction that the salaries of teachers in non-public educational institutions are implemented in accordance with the provisions of the law on labor.
In fact, to attract good teachers, many non-public educational institutions are willing to pay salaries and incomes much higher than the current salaries of teachers in the public sector with the same qualifications and titles. Therefore, the draft Law stipulates to ensure the autonomy of non-public educational institutions in paying teachers' salaries based on practical conditions.
