The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government. Accordingly, the time for calculating seniority allowance for teachers includes the time of teaching and education with compulsory social insurance contributions in public educational institutions (or non-public institutions if the employee is subject to compulsory social insurance participation according to the provisions of the law on labor and education).
Specifically, teachers who have been teaching and educating for 5 years (60 months) and have paid compulsory social insurance are entitled to seniority allowance equal to 5% of their current salary, plus leadership position allowance and seniority allowance exceeding the framework (if any). From the 6th year onwards, each year is calculated with an additional 1%.
According to your letter, you were recruited as an education officer in February 2020. Before that, you had a teaching contract at a high school from September 2018 to January 2020 and paid compulsory social insurance.
According to current regulations, teaching time from September 2018 will be accumulated to consider seniority allowance. When appointed to the professional title of teacher, you will be considered for seniority allowance if you have 5 consecutive (or accumulated) years of teaching, excluding probationary period.
Because it has not been considered at the right time, you can apply for the back payment of seniority allowance as prescribed. We recommend that you contact the school or the competent authority for instructions on completing the back payment application.
