There will be interconnectedness in the use of human resources between the public and private sectors.

On the morning of October 22nd, presenting the draft Law on Public Employees (amended) at the National Assembly session, Minister of Home Affairs Pham Thi Thanh Tra stated that the approach to drafting the law will inherit existing regulations that are still valid; and amend and supplement regulations on recruitment, employment, and management of public employees according to job positions...

The draft includes provisions for reforming the recruitment, employment, and management of civil servants based on job positions. Accordingly, the draft clearly stipulates that the recruitment, management, placement, and utilization of civil servants must be based on the requirements of the job position and the civil servant's competence and performance; and that examinations or assessments for promotion to higher professional ranks for civil servants will not be implemented.

Recruitment of public employees should clearly define competitive examination methods, open and equal selection processes, and methods for accepting high-quality human resources. Public service units should have the autonomy to choose recruitment methods suitable to their sector and field of activity, aiming for a professional and modern management model. For cases where civil servants or public employees transfer to work at a new public service unit, the transfer procedure must be followed.

Minister Pham Thi Thanh Tra also stated that the draft law expands the rights of civil servants by stipulating the conditions under which civil servants can sign contracts to perform professional activities at public service units other than the public service unit where they currently work, or at other non-public agencies, organizations, or units; civil servants working in public science and technology organizations and public higher education institutions can participate in capital contribution, participate in the management and operation of enterprises, work in enterprises established by those organizations, or participate in establishing enterprises to commercialize research results created by those organizations with the consent of the head of the organization.

In cases where the managerial official is the head of a public science and technology organization or a public higher education institution, approval from the superior authority is required; at the same time, regulations should be added to encourage and protect officials who are innovative, daring to think, daring to act, daring to make breakthroughs, and daring to take responsibility for the common good.

In addition, the draft law will innovate the mechanism for determining job positions by clearly defining three groups of job positions in public non-business units: management positions (leadership and management positions appointed according to Party regulations); professional and technical positions according to each specialized field in public non-business units; and support positions (excluding service positions, drivers, security guards, janitors, etc.).

The draft Law on Public Employees (amended) will also create linkages in the use of human resources between the public and private sectors, implementing a mechanism to attract and utilize high-quality human resources. Accordingly, the draft stipulates that this linkage aims to create a mechanism to attract and value high-quality human resources to work in the public sector.

Minister of Home Affairs Pham Thi Thanh Tra also stated that the draft law will innovate the governance of public service units, linked to improving the efficiency of managing the civil servant workforce; and reform the civil servant evaluation mechanism to improve the quality and efficiency of service to the people and society.

In the report reviewing the draft Law on Public Employees (amended), the Chairman of the National Assembly's Committee on Law and Justice, Hoang Thanh Tung, stated that many opinions within the committee supported the regulations on policies for developing public service units, as this content inherits from the current Law on Public Employees and serves as the basis for the Government to issue a decree on the organization and operation of public service units.

Meanwhile, regarding the content of reforming the mechanism for recruiting, employing, and managing civil servants according to job positions, the committee basically agreed with the transformation of the civil servant management method according to job positions to suit the current trend of public sector reform, meeting the requirement of "strongly reforming the methods of recruitment, evaluation, planning, training, fostering, placement, and utilization of cadres, civil servants, and public employees in the political system."

With regard to related regulations, the Committee on Law and Justice agrees that civil servants may enter into labor contracts or service contracts with other agencies, organizations, or units, provided that these agreements do not violate the terms of the employment contract and are not prohibited by law, in order to utilize their professional skills and experience in their work to contribute to society and increase their legitimate income…
