
Intellectual property – a new resource for raising capital.
A highlight of the amended Law is the addition of Article 8a on financing based on intellectual property rights, allowing intellectual property rights to be considered as a type of asset for valuation, collateral, and capital mobilization. This is a mechanism that the business community has been hoping for for many years.
Under the new law, owners can independently value intellectual property rights not recorded in the accounting books, create asset lists for trading and management. The government will build a national database of legally tradable values and issue a unified valuation methodology, creating a foundation for a transparent intellectual property market.
In addition, the Ministry of Science and Technology will coordinate with other ministries and agencies to pilot a model of using intellectual property rights as collateral for loans, raising capital through the stock market, and developing intellectual property insurance. This is a common international trend, as intangible assets account for approximately 80% of enterprise value in developed economies; the S&P 500 group in the US exceeds 90%.
Deputy Minister of Science and Technology Hoang Minh emphasized that developing the intellectual property market will contribute to improving productivity, product quality, increasing competitiveness, and creating new resources for innovation.

Legal breakthroughs are boosting the commercialization of knowledge.
Speaking at a recent meeting with the Intellectual Property Office, Minister Nguyen Manh Hung affirmed that science and technology can only develop sustainably when research results are commercialized.
"Intellectual property transforms research results into assets. Once they become assets, we can value them, transfer them, lease them, and mortgage them to generate new capital," the Minister emphasized, while also suggesting leveraging global intelligence for breakthroughs.
This revised law amends 76 articles and adds many new provisions to keep pace with international trends: expanding the definition of industrial designs to the digital environment; allowing the use of legally available data to train artificial intelligence without infringing on the legitimate rights of authors; simplifying administrative procedures, and moving towards full-process online management.
The law also strengthens measures to protect intellectual property rights, adds mechanisms to combat monopolistic abuse, and enhances the coordinated responsibility of courts and prosecutors in handling disputes. The role of intermediary organizations such as collective copyright management organizations and industrial property representative organizations is tightened to ensure transparency and better protection of rights holders.
The fact that the Law was passed with a high approval rate reflects a strong consensus on the need to establish a modern intellectual property market. Once the guiding regulations are issued, intellectual property rights will truly become a crucial resource for economic growth, enhancing Vietnam's position in the global innovation value chain.
