Quickly resolve the petitions of households living along National Highway 47C through Tho Phu commune

Thanh Hoa Newspaper and Radio - Television Station received a petition from people living along National Highway 47C section through Tho Phu commune, petitioning the local government to take residential land from many households to build a traffic corridor without compensation for site clearance. The households have repeatedly requested to have the above land area returned, but so far the local government has not resolved the matter.

Quickly resolve the petitions of households living along National Highway 47C through Tho Phu commune

People of Tho Phu commune reflect the incident.

From the people's complaints and through actual research, it is known that Provincial Road 506 passing through Tho Phu commune was expanded in 1983. According to the 1985 cadastral map of Tho Vuc commune, former Trieu Son district, the road passing through the commune is about 1.6km long, 18m wide (including roadbed, drainage ditches and traffic corridors), the road centerline is 9m. Most households living along the road have built solid houses on residential land. These plots of land are all recognized by the State and the location, distance, and road centerline are determined on the administrative boundary map of Tho Vuc commune. In 2009, the local government notified the people about the land clearance to upgrade the road. Households living along the road all agreed with the above policy. However, by 2015, Provincial Road 506 was converted into National Highway 47C. Then, in 2017, implementing the plan to clear the traffic safety corridor, the People's Committee of Trieu Son district issued a notice on the forced clearance of the traffic safety corridor on National Highway 47C for households in Tho Vuc commune. At this time, many households did not agree because they thought they were using their family's residential land and not encroaching on the traffic safety corridor.

According to the feedback of affected households, from 2011 to 2015, when households issued new and exchanged land use right certificates (LURCs), the road centerline distance changed, no longer 9m as previously determined by the Tho Vuc commune cadastral map.

Mr. Pham Van Noi in village 3, Tho Phu commune said: “We are using residential land left by our ancestors, now we have become violators of the traffic safety corridor. The land identified by the People's Committee of Trieu Son district as a traffic safety corridor is our land, and has not been decided by the competent authority to recover and compensate. We request the People's Committee of Tho Phu commune to consider, recognize and issue land use right certificates for the land the State took from households to build a traffic safety corridor.”

Mr. Do The Ben in Hoa Trung Thuong village, Tho Phu commune expressed his concern: "My parents divided a plot of land for my siblings, but each household deducted the center of the road differently. Specifically, my plot of land deducted 7.5m, my brother's plot of land deducted 9m. What we wonder is why the same road, even the same divided plot of land, has different landmarks to determine the center of the road."

Responding to the issues raised by the people, the leader of Tho Phu Commune People's Committee explained that according to the local cadastral maps, Provincial Road 506 (now National Highway 47C) passes through 4 villages of the commune, the road width is 18m, the road centerline is 9m. Due to the process of upgrading and renovating the road, according to the 2011 cadastral map, when measuring the current land use status of households, there were changes compared to before. Therefore, when households registered land changes and prepared documents for granting land use right certificates, the road centerline changed from 7.5m to 9m. Currently, households have been granted land use right certificates, which clearly state the road centerline for each plot of land. In 2017, implementing the plan to clear the traffic safety corridor on National Highway 47C, the People's Committee of Trieu Son district directed the People's Committee of the commune to remove some canopies, roofs, and trees located within the land use boundaries of households, obstructing the view and affecting traffic safety. However, many households along the road did not agree to the removal and requested to re-grant the land that the State had previously recovered to widen the road since 1983.

Vice Chairwoman of Tho Phu Commune People's Committee Hoang Thi Sam said: "The Commune People's Committee has received petitions from 39 households along National Highway 47C. Among these households, only two households made mistakes when preparing documents for granting land use right certificates, incorrectly recording the road centerline from 9m to 13m. We are taking steps to make adjustments. The other households have all been granted land use right certificates according to the measurements and reality of each plot of land. The Commune People's Committee does not have the authority to return the land in the traffic safety corridor to the households. To completely resolve the petitions of the households, the Commune People's Committee has sent a document requesting departments, branches and the Provincial People's Committee to consider and take measures to handle the matter."
