According to current legal regulations, the above area is not allowed to build solid structures. However, recently, due to the need for housing, some households have built houses on the land purchased from the commune. Currently, the commune government has suspended construction for households that built illegally, but there is no specific plan to resolve land rights for the people.

In 2006, Ms. Tran Thi Hien's family in Trung Tam village bought a 150m2 plot of land worth 45 million VND from Ha Yen commune (old). The family's representative paid the full amount and the commune had a receipt showing the land transaction. Because her children had grown up and started their own families, there was a need to separate the household and build a house. By the end of March 2025, her family had gathered construction materials to build a house and the foundation of the house had been formed on an area of ​​150m2. However, after the commune authorities learned of the incident, the project was suspended. Because the construction of her family's house at this location is currently within the Hoat River dike protection corridor, it is not allowed to build a solid structure. Unable to hide her worries and concerns, Ms. Hien shared: “Now that my children are grown up, the house is cramped, so I planned to build a house to separate households, but the commune government did not allow the construction anymore. My family does not know what to do now.”

According to Resolution No. 84/NQ-HDND dated December 7, 2017 of the Provincial People's Council on "Planning for flood prevention and control of diked rivers in Thanh Hoa province in 2025 and orientation to 2030", it is strictly forbidden to act to affect flood drainage flow. Construction works built before 2018 must remain in their current state, and no repairs or new constructions within the dike protection corridor are allowed.

Through investigation, it is known that in August 2006, Ha Yen commune (old) sold 29 plots of land without authority to local households, with prices ranging from 40 - 45 million VND/plot of land with an area of ​​150m2. After the land was allocated, 13 households built houses and solid structures and have been living there stably since then. However, recently, some households with land along the right dike of Hoat River, through Hoat Giang commune, dumped soil, rocks, and materials to build houses within the dike protection corridor. Immediately after grasping the situation, the commune government coordinated with Ha Trung Dike Management Department to inspect and handle households violating the dike protection corridor. Through the inspection, it was determined that there were 10 locations where households were dumping soil and constructing structures within the Hoat River dike protection corridor. After discovering that households were constructing structures in violation of the dike protection corridor, the commune government requested that the construction be stopped. They sympathized with the people because they bought the land and had a real need to live, but construction in the Hoat River dike protection corridor was not allowed.

The current disadvantage of households is that they buy land but cannot use it. Therefore, the commune government will report the incident to higher levels to have a plan to ensure the rights of households, such as resettlement arrangements, land for land, compensation or refunds to households that have bought land from the commune. This is also the wish and aspiration of households that have bought land without the authority of Ha Yen commune (old) since 2006. Representing the households, Mr. Le Xuan Tu, Party cell secretary, head of Trung Tam village, said: “The wish of the people is that after buying land, they must be able to use it. If they cannot use it, the commune government must have a plan to ensure the rights of the people. We have bought land for nearly 20 years but have not been able to use it, it is a great disadvantage!”

Before the competent authorities consider and propose a solution, households need to comply with the provisions of the law, not intentionally build illegal structures that affect flood drainage on the Hoat River, especially when the flood season is approaching.
