Amending and supplementing regulations on the highest rank for officer positions

In the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army, the Ministry of National Defense proposed amending and supplementing regulations on the highest rank for officer positions.

The highest military rank for an officer's position

Specifically, the proposal to amend and supplement Article 15 of the Law on Officers of the Vietnam People's Army No. 16/1999/QH10, which has been amended and supplemented in Clause 4, Article 1 of Law No. 19/2008/QH12 and Clause 3, Article 1 of Law No. 72/2014/QH13:

1. The highest military rank for an officer's position is specified as follows:

+ General, no more than 3, including:

Minister of Defense;

Chief of the General Staff; Director of the General Political Department.

+ Senior General, Navy Admiral, no more than 14, including:

The Deputy Minister of National Defense has the highest military rank of Senior Lieutenant General, Admiral of the Navy no more than 6;

Deputy Chief of the General Staff, Deputy Director of the General Department of Politics: Each position has the highest military rank of Senior Lieutenant General, no more than 3;

Director, Political Commissar of National Defense Academy;

+ The positions and titles with the highest military ranks are Lieutenant General, Vice Admiral of the Navy, Major General, Rear Admiral of the Navy; the number does not exceed 398;

+ The positions and titles specified from point h to point r in Clause 1, Article 11 of this Law and equivalent positions and titles have the highest military rank of colonel and lieutenant.

2. A seconded People's Army officer approved to hold the position of Standing Member of the National Assembly 's Committee on National Defense and Security or appointed to the position of General Director or equivalent has the highest military rank of Major General;

A seconded People's Army officer approved to hold the position of Deputy Chairman of the National Assembly's Committee on National Defense and Security or appointed to the position of Deputy Minister or equivalent has the highest military rank of Lieutenant General;

The People's Army officer seconded to hold the position of Chairman of the National Assembly's Defense and Security Committee has the highest military rank of Senior Lieutenant General;

3. Seconded People's Army officers with higher positions than those specified in Clause 2 of this Article and in special cases, they are conferred or promoted to the rank of general as decided by competent authorities.

4. The Government specifically stipulates that the position with the highest military rank is Lieutenant General, Major General and the highest military rank for the position and title of an officer is the general rank of a newly established unit, a reorganized unit, or a unit with additional functions and tasks, but not exceeding the maximum number of general-rank positions according to the decision of the competent authority.

5. The highest military rank for an officer's position or title is colonel or lieutenant, as prescribed by the Minister of National Defense.

Age of active officers considered for promotion from Colonel to Major General

In the draft Law, the Ministry of National Defense also proposed to amend and supplement a number of clauses of Article 17 of the Law on Officers of the Vietnam People's Army No. 16/1999/QH10, which has been amended and supplemented in Clause 4, Article 1 of Law No. 72/2014/QH13:

a) Amend and supplement Clause 3 as follows:

“3. The age of active officers considered for promotion from the rank of Colonel to Major General or Rear Admiral of the Navy must have at least 3 years of service remaining. In case of not having 3 years of service remaining, upon request, the President shall decide.”

b) Amend and supplement Clause 4 as follows:

“4. Active officers with outstanding achievements will be considered for promotion to a higher rank, but not exceeding the highest rank for the position or title the officer is holding.

The Government shall prescribe the criteria and standards specified in this Clause for consideration of promotion to the rank of general officer beyond the rank of general.

The Minister of National Defense shall specify the criteria and standards prescribed in this Clause for considering the promotion of officers of the rank of colonel and lieutenant beyond their rank.
