Accordingly, the Provincial People's Committee directs departments, branches, sectors and localities to seriously implement the directions of the Government, the Prime Minister and the Provincial People's Committee on launching a peak period to fight against and repel smuggling, trade fraud, counterfeit goods and intellectual property infringement; proactively direct the organization of forces and means, and have appropriate solutions to effectively carry out the task of combating smuggling, trade fraud, counterfeit goods and intellectual property infringement in the fields and areas under their management and responsibility. Clearly identify key subjects, areas, sectors and goods to focus on the fight with the motto "handling one case, warning the whole region and field", "no forbidden areas, no exceptions"; improve management capacity, define responsibilities, functions and tasks, avoid overlapping or missing tasks, and leave no gaps in state management, ensuring the principle of "clear people, clear work, clear responsibilities".
Through practical implementation, promptly detect existing problems and shortcomings in mechanisms, policies and legal regulations to promptly promulgate, amend, supplement or recommend competent authorities to amend and supplement.
The Provincial Fatherland Front Committee and its member organizations closely coordinate with departments, branches, sectors, and local authorities to mobilize union members, association members, and people to build a mass movement to participate in the fight against and denounce violations of smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights.
The Party Committee and local authorities lead and direct the entire local political system to actively participate in the fight against smuggling, trade fraud, counterfeit goods, and intellectual property rights infringement. In particular, promptly detect, rectify, and overcome limitations and shortcomings; strictly handle officials and civil servants who lack responsibility, slacken leadership, direction, management, and violate the fight against smuggling, trade fraud, counterfeit goods, and intellectual property rights infringement.
Departments, branches, localities, and functional forces shall proactively arrange resources, develop plans or direct the timely and effective implementation of Official Dispatch No. 65/CD-TTg dated May 15, 2025, Directive No. 13/CT-TTg dated May 17, 2025, Official Dispatch No. 72/CD-TTg dated May 24, 2025 of the Prime Minister; tasks assigned in Plan No. 1309/KH-UBND dated May 20, 2025 of the Provincial People's Committee to launch a peak period to fight against and repel smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights in Ha Nam province, from May 15 to June 15, 2025.
The provincial police directed professional forces and local police to establish special projects, resolutely fight against and strictly handle criminal acts; coordinate with prosecution agencies to speed up the investigation, prosecution and trial of cases; clarify the responsibilities of relevant organizations and individuals, report and propose handling according to regulations; promptly publicize the results on mass media for general deterrence and prevention.
Take the lead in proposing and advising on measures, methods, and approaches, closely coordinate with relevant departments, branches, and units to grasp the situation of violations, smuggling crimes, trade fraud, counterfeit goods, and intellectual property infringement; closely coordinate with departments, branches, localities, and functional forces in inspecting and handling violations.
The Department of Industry and Trade directs the Market Management force to strengthen inspection and strictly handle cases of smuggling, production and trade of counterfeit goods, infringement of intellectual property rights, goods of unknown origin, especially violations in the e-commerce environment. Review production and business establishments, warehouses, gathering points, and transportation of goods in the area, focusing on essential goods, goods that are prone to violations under the management scope; business activities on digital platforms. Proactively or coordinate with the Provincial Police, Department of Science and Technology; Department of Health, Department of Agriculture and Environment in post-inspection of goods quality.
The Department of Science and Technology reviews the establishments under its management functions and tasks; the situation of production, business, and circulation of goods in the area related to quality, technical standards, measurement, and intellectual property. Focus on essential goods, products at high risk of counterfeiting and intellectual property infringement; inspect and appraise the quality of products and goods when there are signs of violations, promptly provide inspection and appraisal results to serve the investigation and handling of violations. Advise the Provincial People's Committee on solutions to promote the application of science and technology in product quality management, anti-counterfeiting, protection of business brands and consumer rights.
The Department of Health reviews facilities under its management functions and tasks; the situation of compliance with food hygiene and safety, especially in industrial zones/clusters, schools, restaurants, collective kitchens, etc. Strengthen and promote inspection and strict handling of the trading and business of counterfeit and smuggled drugs; do not allow counterfeit, smuggled drugs, cosmetics, and functional foods of unknown origin into the area; play a key role, resolutely fight and repel, and end the situation of counterfeit drugs, considering the care and protection of people's health as the top priority. Focus on appraisal, testing, and post-inspection; coordinate the appraisal of samples of goods suspected of being counterfeit or poor quality goods.
The Department of Agriculture and Environment reviews facilities under its management functions and tasks. Strengthen inspection and strictly handle violations of forestry products, aquatic products, production and trade of fake plant varieties, livestock, fertilizers and pesticides; control the use of stimulants and chemicals; quarantine fruits, foods, livestock and poultry, ensure quality and food safety, and avoid affecting people's health. Focus on appraisal, testing and post-inspection; coordinate in taking samples for appraisal of goods suspected of being counterfeit or poor quality goods.
Ha Nam Newspaper strengthens propaganda to raise public awareness in the fight against smuggling, trade fraud, counterfeit goods, implementation methods, skills to identify and distinguish infringing goods; closely coordinates with functional agencies to provide official news, orient public opinion, avoid spreading false information, causing confusion among the people. Review and strictly control advertising activities to ensure advertising information is accurate and truthful.
The Department of Construction reviews facilities under its management functions and tasks, focusing on construction materials and fuels. Focuses on appraisal, testing, and post-inspection; coordinates appraisal of suspected counterfeit and poor quality goods. Directs strict control of freight transport activities on roads, railways, and waterways to detect and prevent illegal goods in circulation and at stations, bus stations, wharves, and assembly locations.
The Department of Education and Training coordinates with the Department of Health and the Department of Agriculture and Environment to inspect kitchens at educational institutions; direct functional departments to closely inspect and monitor food sources used in educational institutions throughout the province, to prevent the use of fake foods, foods that do not ensure food safety, and affect the health of students and teachers.
The Provincial Industrial Park Management Board coordinates with the Department of Health and the Department of Agriculture and Environment to inspect kitchens in industrial parks; directs businesses to closely inspect and monitor food sources used in processing industrial meals to serve workers and laborers in companies and businesses in industrial parks throughout the province.
The Department of Culture, Sports and Tourism shall strengthen the inspection and supervision of advertising, display and introduction of products and goods in the province, especially on media, social networks, fairs and trade exhibitions, ensuring compliance with legal regulations; proactively monitor, detect and strictly handle acts of false advertising, especially on social networks.
The Regional Customs Branch IV has measures to detect, promptly prevent, investigate and handle acts of smuggling, trade fraud, counterfeit goods, and intellectual property infringement in import and export activities; closely inspect and monitor goods in transit, port transfers, temporary imports and re-exports, especially consumer goods and goods at risk of smuggling and recirculation into the domestic market in the area. Strengthen and improve the quality of post-inspection and post-clearance inspection, promptly detect and handle cases of taking advantage of the open policy on customs control and clearance for smuggling and trade fraud.
The Regional Tax Department IV reviews establishments under its management functions and tasks to promptly detect signs of violations regarding invoices, documents, tax evasion, tax fraud, and the origin of goods and raw materials. Strengthen tax inspection and examination, promptly handle violations and fraud in tax declaration and payment; in the management and use of invoices, especially cases of using invoices to legalize the origin of smuggled goods. Strengthen tax management for business activities on the internet platform.
People's Committees of districts, towns and cities shall strengthen the management of areas and markets, grasp the situation, subjects, methods and tricks of smuggling, trade fraud, counterfeit goods and intellectual property infringement; proactively coordinate with functional forces (Market Management, Police, Customs...) to develop plans to inspect and control key routes, areas and fields; organize interdisciplinary inspection teams or conduct surprise inspections of establishments showing signs of violations of smuggling, trade fraud, counterfeit goods and intellectual property infringement.
