Strengthening the management and use of electronic invoices in petroleum business and retail

On December 1, Prime Minister Pham Minh Chinh signed Official Dispatch No. 1284/CD-TTg on strengthening the management and use of electronic invoices for petroleum business and retail activities.

The dispatch clearly stated: Following the dispatch No. 1123/CD-TTg dated November 18, 2023 on strengthening the management and use of electronic invoices, contributing to promoting digital transformation, in order to strengthen the management and use of electronic invoices for petroleum business and retail activities, contributing to creating a fair and favorable business environment, protecting the interests of consumers and contributing to combating negativity, corruption and smuggling; The Prime Minister requested the Ministers, Heads of ministerial-level agencies, Government agencies, Chairmen of People's Committees of provinces and centrally run cities to urgently carry out the tasks.

The Minister of Finance directed tax authorities at all levels to continue to promote and diversify measures and solutions to disseminate to taxpayers, stores, and petroleum businesses the regulations on issuing electronic invoices for each sale in Decree No. 123/2020/ND-CP dated October 19, 2020 of the Government regulating invoices and documents.

The Minister of Finance shall preside over and coordinate with the Minister of Industry and Trade, the Minister of Science and Technology, the Minister of Information and Communications, the Minister of Public Security and the Chairmen of the People's Committees of provinces and centrally-run cities to immediately deploy synchronous and effective solutions, resolutely requiring petroleum business units to issue electronic invoices for each sale at petroleum retail stores and connect data with tax authorities according to regulations; to be completed in December 2023.

The Minister of Finance shall preside over and coordinate with the Minister of Public Security, the Minister of Information and Communications and relevant agencies to develop and complete the information technology system for electronic invoices, ensuring that the reception and connection of electronic invoice information by tax authorities is smooth and convenient, contributing to improving the efficiency of tax management; to be completed no later than the first quarter of 2024.

The Minister of Finance directed the tax authorities to coordinate with the police and other relevant agencies to strengthen inspection and examination of electronic invoices at petrol stations, ensuring compliance with legal regulations, and strictly handle according to the law if they do not comply or intentionally do not comply.

The Minister of Industry and Trade directs market management agencies to closely monitor, organize inspections and audits of compliance with legal regulations on petroleum trading by petroleum trading establishments in the area, strictly and promptly handle all violations of regulations on petroleum trading conditions; coordinate with tax authorities to inspect, supervise and handle violations of the law on electronic invoices for each sale of petroleum trading units in accordance with legal regulations.

Ministers of ministries and heads of relevant agencies closely coordinate with the Minister of Finance in connecting, sharing information, data, inspection, examination and supervision of the issuance and use of electronic invoices, especially in the petroleum sector... to improve the efficiency and effectiveness of tax management, prevent tax fraud, tax evasion and tax loss.

The Chairman of the People's Committee of the provinces and centrally run cities directs local agencies (finance, industry and trade, public security, communications, planning and investment, science and technology, etc.) to closely coordinate with tax authorities to grasp the current situation of electronic invoice implementation for each sale, the level and ability to meet the implementation of electronic invoices for each sale, connect with tax authorities of local retail gasoline stores to advise and propose to the Chairman of the People's Committee of the provinces and centrally run cities drastic solutions and measures to promote and supervise local gasoline retail businesses to issue electronic invoices after each sale according to regulations.

Chairmen of People's Committees of provinces and centrally-run cities shall strengthen the direction of local departments and branches to closely coordinate with tax authorities to promote management, inspection, supervision, detection and strict handling of violations, failure to implement or intentional failure to issue electronic invoices for each sale of petroleum retail activities in the locality and electronic connection with tax authorities.

The Prime Minister assigned Deputy Prime Minister Le Minh Khai to directly direct and inspect the implementation of this Official Dispatch.

The Government Office monitors and urges according to assigned functions and tasks, promptly reports to the Prime Minister on arising issues beyond its authority according to regulations./.
