On the morning of August 15, when questioning the Minister of Justice at the 25th session of the National Assembly Standing Committee, delegates stated that during this term, the Ministry of Justice has made more thorough preparations for the Law and Ordinance Development Program.
However, the situation of slow issuance of documents still exists. There are contents that have been proposed many times before but have not been issued, or have been issued without proper authority, not in accordance with the provisions of legal documents.
According to delegate Dieu Huynh Sang ( Binh Phuoc ), the results of the supervision of legal documents by the National Assembly's Ethnic Council and Committees in 2022 showed that there were contents that had been recommended in many previous supervisions but had not yet been issued.
There are still some legal documents showing signs of not ensuring the legality and consistency of the legal system.
There are contents of direct authorization or issuance that are not within the authority and the form of some detailed regulations is not suitable or in accordance with the provisions of the Law on Promulgation of Legal Documents.
“The review and announcement of expired legal documents is still slow and the above contents have been mentioned in the Government ’s annual report on thrift practice and waste prevention but have not been resolved yet. What are the solutions and responsibilities of the Minister in the coming time?”, the delegate asked.
Responding to questions from delegates, Minister of Justice Le Thanh Long said: "Debt and slow issuance of documents have been issues for a long time, we have discussed them but have not yet resolved them completely... However, in 2021, there is an increasing trend. Our data shows an increase of 6 documents compared to 2022," said the Minister.
According to the minister, in the past, the Nationalities Council and the National Assembly's committees have conducted supervision, and the National Assembly Secretary General has also reported on this issue, but the data is not consistent. Therefore, it is necessary to review and research to ensure compatibility in details.
In general, it can be affirmed that there are delays and debt documents. Despite great efforts, there are decrees that have been delayed for a long time and have not been processed, for example, the Decree on labor representative organizations and collective bargaining, processing for the Labor Code; Decree on administrative sanctions in the fields of fisheries, network security, etc.
Analyzing the cause, the minister said that because there were too many contents assigned with detailed regulations, or some resolutions had short-term effects, it was necessary to urgently issue a replacement resolution...
To provide a solution to this problem, the Minister of Information and the Prime Minister issued a Resolution on a number of solutions to overcome difficulties and shortcomings in the work of drafting legal documents, including regulations to ensure administrative discipline in drafting and promulgating legal documents.
The Minister also said that Regulation 69-QD/TW on disciplining party organizations and party members who violate the law is a very powerful tool. The Politburo is also directing the submission of Politburo regulations on a number of solutions to prevent and combat corruption, negativity, and group interests in the work of drafting documents.
In the long term, the minister said that in law-making, it is necessary to clearly stipulate many specific issues in the law, and should not rely on the development of explanatory and guiding documents.
Regarding the review of legal documents, the Minister said that since Report No. 442 was submitted to the Standing Committee of the previous National Assembly, the Ministry has submitted 10 different review reports.
In the near future, the units will submit to the National Assembly a review report on more than 22 areas.
Review work takes time to carry out. During the review, there needs to be discussion to have plans for revision, supplementation, and adjustment. The responsibility for review of ministries, branches, and units also needs to be enhanced.
One of the important tasks that needs to be done is to review the recommendations to avoid duplication. In addition, we need to focus on preparing the report to be submitted to the National Assembly at the upcoming 6th Session.
